It has been contended by the appeliants that the respondents were initialiy engaged as Telecom Mechanics and they are seeking declaration that they are entitled for placement in the pay sca-le of Rs.40O0- 60O0 in the cadre of Telecom Mechanics on completion of 16 years of service from the date of their first appointment AS regular MazdoorlGroup-D/ Telegrapher in terms of the judgment of the Central Administrative Tribunal, Hyderabad (for short 'the Tribunal') in O.A.No.1966 of 1999 dt.09-08-2O00 and the learned Single Judge has a-llowed the Writ Petitions without appreciating any of the contentions raised by the appellalts. The learned counsel for the appellants had further contended that the learned Single Judge has failed to appreciate that as per the office memorandum dt.20-04-1999, only three categories ol employees viz., Phone Mechanics, Senior TOAs and TTAs were entitled for such placement and admittedly, the respondents were not initially appointed as Phone ) HCJ & AKS.J W A No l99l of200i & barch Mechanics and that is the reason why the appellants have denied the benefit of office memorandum dt.2O-O4-I999 to the respondent-employees as the respondent-employees were initially engaged as regular Mazdoors in Telecom Department and they were working AS Group-D category and therefore the respondent-employees were r-rot entitled for the benefit of pay fixation in terms of office memorandum dt.2O-O4-1999. But the learned Single .Iudge has mechanically followed the orders passed by the Tribunal in respect of Telecom Mechanics in O.A.No.1966 of 1999 dt.09-08-2o00 and allowed the Writ Petitions in favour of the respondent-employees.

Learned counsel for the appellants had further contended that no doubt, the ordcr passed by the Tribunal in O.A.No.1966 of 1999 dt.09-08-2000 rvas confirmed by this Court in W.P.No. 14744 of 200 1 dt. 16-10-2003 but the learned Single Judge has failed to appreciate that the respondent-employees stand on + |r( t& AKs J W.A No.lqSl of2005 & barch different footing and they were not entitled for the benefit of office memorandum dt.2O-O4-1999 and therefore, learned counsel for the appellants had contended that appropriate orders be passed in the Writ Appeals by setting aside the orders of the learned Single Judge.

Learned counsel for respondent-employees had contended that the office memorandum dt.2O-O4-1999 was made available in respect of three categories of employees viz., Phone Mechanics, Senior TOAs and TTAs and when the benefit of office memorandum dt.2O-O4-1999 was not extended in respect of employees of department of Telecommunication, the said employees have approached. before the Tribunal by hling O.A.No. 1966 of 1999 and the Tribunal was pleased to a1low the said O.A. vide orders dt.09-08-2000 and the same was also confirmed by the Division Bench of this Court in W.P.No. 14744 of 2003 dt. 16- 1O-l^n:, and further \ -) }ICJ & AKS.J \\ A \o l99l of200i & balch confirmed by the Honble Supreme Court in S.L.P.No.5734 of 2OO4 dt.23-O7-2OO4 and later, B.S.N.L. was carved out from the department of Telecommunication as the jurisdiction of Tribuna-l has been ousted for the employees of B.S.N.L. The respondent-employees have rightly approached this Court by filing a batch of Writ Petitions i.e. W.P.Nos.24509 of 2005 and batch and the learned Single Judge has rightly allowed the Writ Petitions and held that the respondent-employees are entitled for the benefit of pay fixation in terms of office memorandum dt.20-o4-1999.

Learned counsel for the respondent- employees had further informed the Court that the matter in respect of department of Telecomrnunication employees, which was adjudicated by the Tribunal i.e. in O.A.No196O of L999 dt.09-08-2000, was also confirmed by the Supreme Court wherein it was adjudicated that the Telephone Mechanic working in 6 TICJ & AKS,J W A No Iq9l of2005 & barch Telecommunication Department is entitled for the benefit of office memorandum dt.2O-O4-1999.

This Court having considered the submissions made by the parties is of the considered view that the respondent-employees are identically situated as that of applicants in O.A.No.1966 of 1999 dt.09-08-2000 and the said orders of the Tribunal were confirmed right up to the Supreme Court in S.L.P.No.5734 of 2OO4 preferred by the appellants, which was dismissed confirming the orders of the Tribunal ald earlier, all these Writ Appeals were already dismissed vide orders dt.26-12-2OOS I 29-L2-2OO5 and aggrieved by the said orders passed by the Division Bench, the appellants have a_lso preferred S.L.P. before the Supreme Court and the appellants have chosen to withdraw the said S.L.P. with an intend to prefer Review Petitions before this Court and they have also filed Review Petitions in all the Writ Appeals. 1 HCJ & AKS.J W ,\ No l()91 of2005 & batch

Admittedly, the respondent-employees are working as Phone Mechanics and a perusal of office memorandum dt.2O-O4-1999 r,r,ould make it abundantly clear that the said office memorandum dt.2O-O4-1999 is made applicable in respect of three categories of employees viz., Phone Mechanics, Senior TTAs and TAOs and no lurther distinction can be drawn as to how the respondent-employees have become Phone Mechanics either from the category of regular Mazdoor, or after rendering service, as Group-D employees. Admitledly, as on the date of issuance of office memorandum dt.2o-O4-7999, respondent-employees are working as Phone Mechanics. 1O. The only difference in the instant case is the respondent-employees are the cmployees of B.S.N.L., and the B.S.N.L. was carved out from the department of Telecommunication. Further, the judgment rendered by the Tribunal in O.A.No.l966 of 1999, 8 IICJ & AKS.J w A No l99l of1005 & harch which was confirmcd by this Court in W.P.No. 14744 ot 2003 vide orders dt. 16-10-2003 and the sarle was also confirmed by the Supreme Court in S.L.P.No.5734 of 2OO4 preferred by the appellants vide order dt.23-O7-2OO4, has become final and all the respondent-employees are similarly situated and that the judgment in O.A.No.1966 of 1999 rendered by the Tribunal applies mutatis mutandis to the respondent- employees also and therefore the Writ Appeals are liable to be dismissed as the issue had already attained finality vide orders passed in O.A.No.7966 of 1999 dt.09-08-2000.

Further, Iearned counsei lor the appellants could not point out any new grounds for interference in the present cases and the learned Single Judge has rightly allowed the Writ Petitions preferred by the respondent-employees with a specific finding that a similarly situated persons have approached the Tribunal by liling O.A. No.1966 ol 1999 and the \ 9 Tribunal was pleased to allow the O.A. r,ide orders dt.O9-08-2O00 and the same were a-lso upheid by this Court in W.P.No.L4744 of 20O3 dt.16-1O-20O3 and ir u/as also confirmed by the Supreme Court in S.L.P.No.5734 of 2OO4 vide orders dt.23-O7-2O04 and the only difference in the present batch of cases is that the respondent-employees had become the employees of B.S.N.L. as the B.S.N.L. was carved out from the department of telecommunication and when once the issue as to whether office memorandum dt.2O-O4-lgg9 is applicable to the employees of department of Telecommunication, the sarne analogr has to be applied even in respect of employees of B.S.N.L. as the B.S.N.L. is also part and parcel of the same department. Thereby, the respondent-employees are entitled for the benefit of office rtremorandum dt.20-o4-1999.
