The grievance of the peLitioner is tl:rat the adjacent tand owners have errcroached upon existing pathway/ cart- way f ravel road in SV {o.94 and not allowing the f adjacent pattadars to ingress and egi is further stated that the peli(oner has submitted an ess to reach their helds. The le:rrned Assistant Government Plearler vehemently contended tllat as per Section 24 of t}:re Tr:langana Land Revenue Act, 13 I 7 F asli, states that all publi,: roads, lanes, paths, bridges, clitches, dikes, rivers, streams, tanks, ponds, canals, lakes, and flowrng water, as well as all lands, are the property of Lhe Government. The 'l'ahsildar is corLferred with the power of removal of encroachment, more particularly roads notified in the rrllage revenue maps or the roacls bcing vested with the local authoriLies. Sincc it is stated that the road in Sy.No.94 is a public road/ public pathway, the Tahsildar is responsible for removal of the encroachraent on the representation submitted by the interested persons or affected persons after issuance of notice to the such interested persons or alfected persons.

In view of the above facts and circumstances and since it is stated that the alleged encroachment is with regard to public road/ public pathway, this Court without expressing any opinion as to whether the road existing in Sy. No.94 is a public road or a private road, the ends of lr"Uce *outf I be met, if the Tahsildar is directed to make an enquiry on ttre rJ :presentaLion submitted by the petitioner and in the said enquir5i if it is revealed that there is illegal encroachment of public road/pathway, tJle Respondent No.4-Tahsildar shall remove such illegal encroachment on the public road/pathway and thereby allow the public to utilize the said road/pathway for ingress and egless.
