Learned counsel for the petitioners stated that the petitioners are the owners and possessors of the lands in various survey numbers situated at Veerlapalem Village' Damaracherla Mandal, Miryalaguda Division' It is further stated that their names were incorporated in the revenue records and pattadar pass books have also been issued in their favour ' The lands in question of the petiticners were sought to be acquired for the purpose of establishment of Yadadri Thermal Power Station proposedforconstructionatVeerlapalemVillage'Damaracherla r\r-!- 2 CVBR, J wp_r9o72 2o2s Maadal. It is stated that the responde nts have issued Gazette Notification under the provisions of section i i (1) of the Right to Fair Compensation and Transparency in Land Acquisition, o"', 2013 gor short ..LARR Rehabilitation an< rrct Gazette No.1148, dated24.OZ.2O15 Act, 2ot3,),, ,,".:,::::T:::' thereafter forl0wing the procedure as contemplated under the provisions ol.LARR Act, 2013 an award has been passed uide proceedings No.tr /2196/20i5, dated 28.O1.2O16. It is further stated that treing dissatisfied with the award passed by the respondents, the petitioners said to have submitted an application for re_determination of the compensation under Section 73 read with Section 6ae) of tlte LlLRR Act, 2013 within the time stipulated under the provisions of the Act on 28.12.2024. The grievance of the petitioners is even though the said application has been submitted in the year 2024, the respondents have not referred the same to the District collector for re-determination of the compensation, as per the provisions ofthe LARR Acr, 2013. 3. Learned ,{ssistant Government pleader for Land Acquisition appearing for the respondents had not disputed the application of the petitioners submitted under Section 73 read with 6a(1) of the I,ARR Act, 20I3. J CVBR, J wP-19072 .2025 20 13, the Larrd 4 . As Per the Provisrons of the LARR Act, Acquisition Officer (for short "LAO") is conferred with the power to refer the aPPlication submitted by the petitioners for re- determination of the compensation by the District Collector' In view of the said submissions' the respondent No'3 - LAO 5. is directed to refer the application submitted by the petitioners dated 28. 1,2.2024 for re-determination of the compensation for the acquired lands uide proceedings No'812196 12O15' dated 28.01.2016 to the Respondent No'2-District Collector within a period of four (04) weeks from the date of receipt of a copy of this order. On such receipt of the said application' the District Collector shall dispose of the said application.within a period of two (02) months thereafter in accordance with the provisions of LARR Act, 2013' With the above directions' the Writ Petition is disposed of' 6 There shall be no order as to costs' Miscellaneous applications pending in this P*L+ul' il ?ly' shall stand closed.
