HON'BLE SRI WSTICE C.V.BHASKAR REDDY WRIT PETITION No.18963 of 2ol25 ORDER: This writ petition is hled seeking to declare the action of the respondents in not conducting survey for demarcation of land in Sy.No.19/ l/E/3, to an extent of Ac.0.0340 gts., situated at Khanapur Village, Gandipet Mandal, Rangareddy District, as illegal, arbitrar5r and for other appropriate reliefs.

2. Considered the submissions of the learned counsel for the petitioner and learned Assistarrt Government Pleader for Revenue appearing for the respondents and with their consent this writ petition is disposed of at the admission stage.

It is stated that the land admeasuring Ac.O.O340 gts., in Sy.No. LglI/E/g, situated at Khanapur Village, Gandipet Mandal, Rangareddy District is an agricultural land and the petitioner devolved the same through his father and he is possession and enjo5rment of the same Z CVBR, J W.P.No.18963 2025 and eking out his livelihood by doing cultivation in the subject land. It is further stated that pattadar passbook No.T05070020239, Khata No.376, has been issued in respect of the subject property. It is the further stated that the petitioner made F-Line application uide No.DER022501171483 dated 06.O5.2024 to respondent No.4, by paying requisite fee to conduct survey of the subject land and fix the boundaries. The grievance of the petitioner is that even after receiving the said F-Line application, the respondent authorities a-re not conducting survey and fixing the boundaries.

4. Learned counsel for the petitioner has submitted that in terms of the circular issued by the Commissioner, Survey, Settlements and Land Records, the respondents are bound to consider the application within 45 days from the date of the application after collecting necessaqr charges.

Learned Assistant Government Pleader for Revenue appearing for the respondents has submitted that the respondents will consider the aforesaid F-Line application 3 CVBR, J W.P.No.18963 2025 submitted by the petitioner by following due procedure laid down under law and conduct survey and demarcate the subject land by fixing boundaries.

It is settled law that the Survey Department has the authorit5r to conduct survey arrd demarcate lands in accordance with the provisions of the Telangana Land Revenue Act, 1317 Fasli (Act No. VIII of I3lZ Fasli), the Telangana Survey and Boundaries Act, 1923, and the Rules framed thereunder. The Government has issued various circulars specifying the conditions for conducting surveys, particularly F-Line (field measurement) surveys. Individuals requesting such surveys are required to submit specific documents, and if the conditions stipulated in the circulars are futfilled, the survey and boundary fixation may be conducted. The Commissioner, Survey, Settlements and Land Records, exercising powers under the Telangana Survey and Boundaries Act, 1923, issued relevant circulars from time to time uide Rc.No.Nl/6543/gg, dated

25.07.2OO1, Rc.No.Nl/1408lOZ, dated t3.O7.2OOZ, and Rc.No.N2/1741/2O1O, dated 18.05.2010 stipulating the I j i I l I i 4 CVBR, J W.P.No.18963 2025 conditions for conducting survey of private lands and as per the said circulars, if the petitioner fulfrlls all the conditions of the said circular, it is al obligation for the respondents to conduct survey within the time specihed in the said circulars. t:

In view of the aforesaid discussion, this Court deems it appropriate to dispose of this writ petition directing the respondents to examine the F_line application uid.e No.DERO22SOLITI4B3, dated 06.05.2O24 submitted by the petitioner for conducting survey and demarcation by fixing boundary stones to the subject land and if the petitioner fulfills all the conditions mentioned in the circulars issued by the Commissioner, Survey, Settlements and Land Records from time to time, the respondents shall conduct survey of the subject land, after issuing notices to a-ll the interested/affected persons and adjacent pattadars and after considering their objections, within a period of eight (8) weeks from the date of receipt of a copy of this order. 5 CVBR, J W.P.No.l8963 2025 8.
