VINOD KUMAR w Petitio n No. 1932 1 of 2025 ORDER: Heard learned counsel for the petitioner, learned Government Pleader for Home appearing for respondent Nos.1 to 5, and with the consent of the learned counsel appearing for the parties, the writ petition is taken up for hearing and disposal at the admission stage.

The case of the petitioner, in brief, is that, based on the complaint made by the petitioner, though the respondents_authorities have registered three cases, vide Crime Nos.6/2024 dt.02.0r.2024; 7Lg of 2024 dt.0L.72.2024; and 28 of 2O2S dt.22.0l.2025, are not conducting proper investigation into the aforesaid crimes and are not taking any action b;r filing charge sheet or a report before the jurisdictionar Magistrate, which action of the respondents-authorities it is contended as iilegar, arbitrary, and violative of fundamentar right guaranteed under Articre 21 of the Constitution of India.

Per contra, learned Government pleader for Home appearing on behalf of respondent Nos.1 to 5, while denying the writ averments, would submit that insofar as crime No.6 of 2024 dt.o2.or.2024 is concerned, the authorities after conducting investigation have arready fired a charge sheet and the same having been taken cognrzance by the jurisdictional Magistrate, numbered as C.C.No.g6 of 2024 and is pending trial. 2 -".1 \. A. -rr insofar as Crime No.719 of 2024 dl'OL'12'7024 is concerned' 4. learned Government Pleader submits that the same is under investigation; and that the authorities would take further action on completion of investigation. Insofar as Crime No.28 of 2025 dt'22'Ol'2025 is concerned' learned 5. Government Pleader submits that the respondents-authorities have issued notice on 0B'02.2025 under Section 94 of BNSS' calling upon the petitioner to produce necessary information/documents and the petitioner did not turn up before the authorities and furnish the information/ documentsfortheauthoritiestoproceedwiththeinvestigation.

6. Learned Government Pleader further submits that if only the petitioner furnishes the information in response to the notice issued under Section 94 of BNSS, the authorities would be able to proceed with the further investigation into the aforesaid crime'

7. The aforesaid submission made by the learned Government Pleader appearing on behalf of respondent Nos'1 to 5 is taken on record' B.
