2. Heard Mr. Ja_lti Narendar, learned counsel for the petitioners, Ms. T. Swetcha, leamed Assistant Government Pleader for Land Acquisition appearing for respondent Nos.l, 3 and 8, and learned Assistant Government plr:ader for Roads and Buildings appearing for respondent Nos.2 and 4 to Z.

Learned counsel for the petitioners submitted that the respondent authorities, without issuing any notice a,d without following the provisions of Right to Fair Compensation and Transparency in Land Acquisition, Itehabilitation and Resettlement Act, 2013 (Act No.3O of 2013) (hereinafter referred to, as 'the Act'),.are trying to dispossess the petitioners from the 2 subject property under the guise of widening of road from Shankarpally to Fathepur Chourastha and the same is in violation of Article 300-A of the Constitution of India.

This Court, while admitting the writ petition on 16.12.2O2O, granted interim order directing the respondents that if any portion of the land of the petitioners is required for the purpose of road widening, the same shall be utilized strictly by following the due process under the Act, or by negotiations. The record discloses that the respondent authorities have not hled counter.

5. Learned Assistant Government Pleader for Land Acquisition and learned Assistant Government Pleader for Roads and Buildings submitted that if the subject land is required, the respondents will follow the due process under the provisions of the Act.

6. Taking into consideration the submissions made by the respective parties, without expressing any view on the merits of the case, respondent Nos.2 to 8 are directed to not to dispossess the petitioners form the subject Property without following due process of law. ( I To 1 3
