Harish, Advocate for th: Petitioner, Sri Jithender Rao Veerama la, 'Additional Public Prosecutor on behalf of the Respondent No. and of Sri Praveen Kumar Challa, Advocate for the Respondent No. The Court made the following: COMMON ORDER THE HONOURABLE SRI JUSTICE N.TUKARAMJI l.A.Nos.1 AND 20F 2025 In/And CRIMINAL PETITION No.8226 OF 2025 COMMON ORDER This Criminal Petition is filed under Section 528 of Bharatiya Nagarik SuraAsha Sanhita, 2023 (for short 'the BNSS') seeking quashment of the proceedings against the petitioner in S.C.No. 87 of 2022 on the file of the Special Sessions Judge for Fast Tracking the Cases relating to Atrocities against Women-cum-Xlll, Additional District Judge, Ranga Reddy District at L.B.Nagar.
2. The petitioner is an accused in the Sessions Case registered for the offences punishable under Sections 376, 354-8 & 354-C and 506 of the lndian Penal Code, 1860 (for short 'lPC'). r
3. I have heard Mr. Sri Raju, learned counsel, on behalf of Mr. L. Harish, learned counsel for the petitioner, Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor, representing respondent No.1-State and Mr. Challa Praveen Kumar, learned counsel for respondent No.2l de-facto complainant.
4. Pending this petition, the parties have entered into the compromise and, accordingly, respondent No.2lde-facto .1 2 N-lRrr I. 1.iio;.1 antl 2 0J2025 itr / atd (l r/. l'. 5. This Court vide otder dated 03.07.2025 referred the parties to the Higrr court Legar Services committee for icrentification and to verify the voluntariness in arriving the setflemert. The Secretary, High Court Legal Services Committee, has subntitted report dated 11 .07 .2(t25 stating that the parties were identified by their respective counsel and also on verification of Aadhar Cards/ dentity Cards and the enquiries revealed that the parties have wi[fully and without coercion entered into setflemenUcomprom ise. 6 I have considered the submissions of the learned counsel and perused lhe materials on record

Acr;ording to the prosecution, the petitioneriarcused had been following the de facto comprainant, who works ar; a conductor in T.S R.T.C After somehow obtaining her phone number, he allegedly look inappropriate photographs of her in flre bus and used . them to b,ackmail her into engaging in sexual actl;, threatening to 3! 3 N7R,/
1...1.1xo.;.1 and 2 of 202; t / lttd Cl.P.No.8226 ol ?02; disclose the matter to her husband. lt is further alleged that the accused visited the complainant's residence, committed forcible sexual intercourse, and secretly took nude photographs of her, which he continued to use for blackmail in order to obtain sexual favours since Decembet 2016. He is also alleged to have eltorted money from her. When the complainant blocked his contact number in November 20'19, the accused is said to have informed her husband about the alleged illicit relationship. Subsequently, a police report was filed on 07.02.2020.

Having considered the allegations, the nature of the charged offences, and the age of the parties, and further.taking into account the amicable settlement reached between them, this Court deems it appropriate to restore peace between the parties, in the light of the dictums in Gian Singh v. State of Punjab and anotherl and Anil Mishra v. Stafe of lJ.P.2i State of Madhya Pradesh v. Accrlrdingly, l.A.Nos 1 and 2 of 2025 ar,> allowed. ln consequerrce, the proceedings against the petitioner/accused in S.C.No. 8'7 ot 2022 on the file of the Special Sessions Judge for Fast Tracking the Cases relating to Atrocities against Women-cum- Xlll, Additional District Judge, Ranga Reddy Distrir:t at L.B.Nagar, are hereby quashed.
