Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue a Writ of Habeas Corpus directing the respondents herein to produce the petitioner son Shaik Madeen son of Shaik Nadeem, aged about 22 years, before this Hon'ble court bodily and consequently set him at liberty forthwith. Counsel for the Petitioner: MR.A.RAVI SHANKAR Counsel for the Respondents No1 to 5.: THE ADVOCATE GENERAL The Court, at the stage of admission, made the following: (Oral order: Per: The Hon’ble Mr. Justice Bilal Nazki) This Habeas Corpus petition is filed to direct the respondents to produce the son of the petitioner by name Shaik Madeen s/o Shaik Nadeem, who has been arrested without any authority of law. In the counter affidavit, it is stated that the detenue has been taken into custody by the Police Officials, Hayathnagar police station in connection with crime No. 517 of 2003 registered under Sections 392 and 411 IPC on 06-12-2004. The detenue was produced before the Additional Judicial First Class Magistrate, East & North at L.B. Nagar, Ranga Reddy district and has been remanded to judicial custody and at present he is lodged in the Central Prison, Cherlapally. There is nobody to dispute these assertions. In this view of the matter, no further orders can be passed. However, the detenue can be at liberty to approach the appropriate court for appropriate relief.
