Respondents WHEREAS the Petitioners above named through their Advocate Sri C HARI PREETH presented this Petition under Article 226 ol lhe Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of WRIT OF MANDAMUS, to declare the in action of the respondents herein, particularly 2nd respondent deliberately and illegally issued the present impugned notice, dated. 16.06.2025 along with preliminary voter list (enclosed) by ignoring his own directions through vide Rc.No. 884/2015-HR2, dated. 28 12.2024 including 1st respondent directions through Memo No. 6228|COOP.lll2l2024, daled. 16.12.2024, apart from that, 1st respondent constrained to issued another directions to the 2nd respondent vide Memo No.6228r'COOP.lll2l2024, dated.18.06.2025, Wherein 1st respondent given a specific recornmendations/ directions to the 2nd respondent to implement the orders of the Honble High Court, passed in W.P.No.2807212023, dated. 03.12.2024 including 1st respondent directions vide Memo No. 622B|COOP.lll2l2024, dated. 16.12.2024, still issued the present impugned notice, dated.16.06.2025 along with prelirninary voter list of the 4th respondent society and said impugned notice was displayed and affixed in the notice board of the 4th respondent society, by excluding the petitioners names in the said list, despite petitioners are the members of the 4th respondent society, vide admission Nos.1148 and 1 150, dt. 01 .07.2021 and sane has been illegal, arbitrary, excessive, and its not only adversely affects the functioning and decisions of the duly elected Managing Committee, but also violates the fundamental principles of natural justice and administrative fairness and also said action is ex facie illegal, without jurisdiction and consequently set-aside the present impugned notice, dated.'16.06.2025 along with preliminary voter list(enclosed), which is illegally and deliberately issued by the 2nd respondent. AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of Sri C HARI PREETH Advocate for the Petitioners, directed issue of notice to the Respondents herern to show cause as to why this WRIT PETITION should not be admitted.
