VINOD KUMAR WRIT PETITION No.18936 of 2025 I ORDER: Heard leamed counsel for the petitioner and leamed Govemment Pleader for Home appearing on behalf of respondent Nos.l to 5 and perused the record. With the consent of leamed counsel appearing for the parties, the Writ Petition is taken up for hearing and disposal at admission stage
2. Having regard to the nature ol /rs involved in the Writ Petition and the manner of disposal, this Court is of the view that notice to unofhcial respondents is not necessary for adjudication of the present Writ Petition.
3. The case of the petitioner in brief is that respondent Nos.3 and 4 authorities are calling the petitioner to 4'h respondent Police Station without therebeing any complaint or case registered and thereby interfering with the life and liberty of the petitioner, which action of the respondent authorities, it is contended as illegal, arbitrary and violative of Articles 14, l9 and 2l of the Constitution of India, with a consequential direction not to unnecessarily harass the petitioner without any reasons/crime registered against him. 2

Per contra, Ieamed Govemment Pleader for Home appearing on behalf of respondent Nos.1 to 5 while denying the Writ averments would subn-rit that as there is no complaint or case registered against the petitioner herein on the file of 3'd respondent police Station, there is no necessily for the authorities to call the petitioner to the police Station.

Learned Government Pleader for Home furlher subrnlts that insolar as the 5tl' respondent is concemed, on the basis of cornplaint made by one Siddharth Reddy, a case vide Cr.No.980/2025 dated 14-05-2025 is registered on the file of said police Station, in which case, the petitroner herein is arrayed as Accused No. l.

It is further submitted that the petitioner, on learning of the aforesaid crime being registered against him on the file ol the 5'h respondent Police Station, had obtained anticipatory bail thercin. 7 . Leamed Government Pleader further subrnits that the petitioner is not cooperating with the investigation into the aforesaid crime registered and as such, the respondent authorities could not proceed further with the investigation into the aforesaid crime. i 3

On the aforesaid submissions being made by the leamed Govemment Pleader for Home appearing on behalf of respondent Nos.l to 5, learned counsel for the petitioner submits that as of date, no notice has been issued to the petitioner in connection with Cr.No.980/2025, and in the event of the authorities issuing any notice calling upon the petitioner to submit information/document or appear before the said authority on a particular date, the petitioner would ( ( appear and cooperate with the investigation into the afbresaid crime.

[n view of the aforesaid submissions, and since it is now stated that there is no complaint or case registered against the petitioner herein on the file of 3'd respondent Police Station, this Court is of the view that respondent Nos.3 and 4 authorities are to be directed not to calt the petitioner to the 3'd respondent Police Station without any complaint or case registered against him, except in accordance with law. Further, as a case vide Cr.No.98 012025 is registered against the petitioner on the frle of respondent No.5 Police Station, this Court is of the view that the respondent authorities are to be directed to conduct investigation into the aforesaid crime strictly in accordance with law. .---,- 4
11. Subject to above observations and direction, the Writ petition is disposed of. No costs.
