3. Learned counsel for petitioner subnrit ; that mere arraignment of the petitioner in a criminal carr, ca_nnot be a ground for denial of passport. He relies on the _ludgrrrent of this Court in W.P.No.2469O of 2025, dated03.)9.2025.
4. l,earned Standing Counsel for the respondents submits tl-iat criminal case is pendinll against the petitioner uide C.C.Nos.3469 of 2022 and :188 of 20i9 before the learned I Adriitional Junior Civil Iudge-cum V Additional l4etropolitan Magistrate, Medch a i, Malka.lgiri District, at L.B.Nagar. It is submitted that t-l : respondent authorities rn'ould consicier the petitioner's aF I lication for a period of one year- only, if he obtains permi; ;ion to travel abrcad from the court lvhere the criminal ,:ir ;e is pending against him.

Be that as it may, consiCering the ju:3ment of the coordinate'Bench of this Court in W.P.No.2z lS4 of 2C25, dated 03.09.2025, and the purpose for whic: the passport is being requested by the petitioner, this Cor rt directs the \\l I I -) respondent No.2 to issue the passport to the pe titioner on the follorving conditions i) The petitioner herein shall submit an undertaking along with an affrdavit in C.C.Nos. C.C.Nos.3469 of 2022 and 6488 of 2OL9, pending on the file of learned I Additional Junior Ciwil Judge-cum-V Additional Metropolitan Magistrate, Medchal- Malt ajgiri District, at L.B.Nagar, stating that he shall not leave India during pendency of the said C.Cs., without permission of the Court and that he shall cooperate with trial Court in concluding the proceedings iu the said C.Cs; ii) On filing such an uldertaking as well as aflidavit, the trial Court shall issue a certified copy of the same within two (2) weeks therefrom; iiil The petitioner herein shall submit an application afresh along with certilied copy of this order as well as the aforesaid undertaking before the Passport Oflicer / Authority concerned for issuiog the passport; iv) On filing such an application, the Passport Oflicer/ Authority shall consider the same afresh in the light of the observations made by this Court herein as well as the contents of the undertaking given by the petitioner for issuing the passport, iu accordance with law, within three (O3) weeks from the date of said application; v) Respondent No.2 shall consider the PassPort Rules, 1967 while considering the application for renewing of the passport to the petitioner; vi) The competent authority shall specify the permission period of one year for the petitioner to renew the passport for travelling abroad, and also obtain appropriate undertaking from the petitioner stating that the petitioner shall not overstay the permitted period and shall surrender the passport uPon retum to India. vii| Any other condition as deemed aPproPriate by the trial Court.
