BIIAS KAR REDDY U'RIT PETITION No.186 47 of 2025 ORDER: This writ petition is filed seeking following relief: "For the reasons stated ln the accompanying affidavit' the petitioner herein prays that this Hon'ble High Court mav be pleased to issue a writ' order or direction more particularlv one in the natllle of WRIT OF MANDAMUS to declare the action of official respondents i:.r not arliudicatrng the dispute over the land rn 51"No'114 admeasltring Ac 2.35 gts ancl 51' No 116 admeasuring Ac 2'07 gts situated at lbrahimbad Village' Narsapur Mandal, Medak Distrrct as per the provisions oI PO'l Act' 1977 between the petitioners and unofficial respondents, as irlegar, arbitrary, null and void and violation of provisions of POT Act, 1977 andconsequently to direct the 5tt' respondent to restore the names of the petitioners agarnst the above rand by deleting the names of the unoflicial respondents in terms oI por Act, rg77, and pass such other order or orders as this Hon,bre court may deem fit and proper in the circumstances of the case "

It is stated that petitioners' fathers and grandfathers were the absolute owners and possessors of agricultural land admeasuring Acs 2'35 guntas in Survey No 1 14 and Acs' 2'O7 guntas in Survey No' 1 16' situated at Ibrahimbad Village, Narsapur Mandal' Medak District by virtue of the assignment made by the Government and assignrhent patta certificates were favour of the petitioners' fathers and grandfathers in the year granted in their title and possession was also reflected in the revenue recorcls, but no patta passbooks were given to them' as such they approached the Village Administrative Officer in the year 1994 for getting the palta passbooks and believing him' they handed over the patta certificates to the Village Administrative officer, but taking advantage of the possession of the said patta certilicates' the said Village Administrative Officer got transferred the land in Survey Nos.113, 1i4, 1 15 and 116 in the names of 1970 and 2 CVBR,,I W.P.No.18647 of 2025 his son, daughter and son-in-law in the year 7998-99 and their names were also entered in the revenue records and in pursuance of the said mutation proceedings, respondent Nos.6 to 72 are trying the interfere with the peaceful possession and enjoyment of the petitioners in respect of the subject lands. It is further stated that the petitioners have filed an appeal before the 4th respondent uide Case No.B/4215/2O13 and later it was transferred to the Special Tribunal, Medak District and the Special Tribunal has dismissed the said appeal directing the Tahsildar, Narsapur to examine the matter further, if it ialls under purview of the Telangana Assigned Lands (Prohibition of Transfers) AcL, 7977 uide order dated 08.Ct2.202 1 in Case No.St/F3/a83 12021. The grievance of the petitioners is that they made representations dated 23.06.2021 and 27.O5.2O24 to th,e Tahsildar for cancellation of the illegal 138 proceedings issued in favour of respondent Nos.6 to 12 and to restore their names in respect of the subject lands and consequently issue patta passbooks to the petitioners, but ril1 date the said representations have not been considered by the Tahsildar. Hence, the present writ petition.

Considered the submissions of the iearned counsel for the petitioners and Sri H.Somaiah Ezra Shastri, learned Assistant Government Pleader for Assignment appearing for respondent Nos.1 to 5 ancl q'ith their consent, this r.,,'rit petition is being disposed at the admission stage. In view of the nature of relief sought for in this u,rit petition, issuance of notice to respondent Nos.6 [o 12 is dispensed with. I CVBR' J W.P.No.18647 of 2025

Learned Assistant Government Pleader for Assignment appearing for respondent Nos'1 to 5 has not disputed passing of the order tlated O8.O2.202 1 by the Special Tribunal in Case No'St/F3/483 l2O2l ar,d the representations dated 23 '06'2021 and' 27 'O5 '2024 beirrg submitted by the petitioners to the Tahsildar for cancellation of the i11ega1 138 proceedings issued in favour of respondent Nos 6 to 12 and to restore their names in respecl of Lhe subject Iands and consequently issue patla passbooks to the petrtloners

In vieu' of the said submission' this Court is of the opinion that the ends of justice would be met if the 5th respondent-Tahsildar is directed to examine the nature of the subject lands i e'' agricultural land admeasuring Acs. 2.35 guntas in Survey No' 114 and Acs' 2 07 guntas in Survey No 116' situated at Ibrahimbad Village' Narsapur Mandal' Medak District and its classification and appropriate action may be taken in accordance with law' as weli as all the Persons, who are after issuing notice to the petitioners interested and affected' With the above observations, the Writ Petition is disposed of' 6 There sha11 be no order as to costs' Miscellaneous applications pending' lf anl', 1f,t all stand clos ed. //TRUE COPY// SD/- L.
