GP FOR REVENUE The Court made the following: ORDER ./i ORDER: HON'BLE SRI .IUSTICE C.V.BHASKAR REDDY WRIT PETITION No.18575 of 2o2s This writ petition is filed declaring the action oI respondent No.2 in not considering the application for appeals on demarcation, dated 23.06.2025 submitted by the petitioner seeking for conducting survey and demarcation of the land to an extent of Ac.O.04 guntas in Sy.No.lOlAl6Al A, situated at Khanapur Village, Gandipet Mandal, Ranga Reddy, as illegal, arbiLrary and contrary to the provisions of the Telangana Survey and Boundaries Act, 1923 and for other appropriate reliefs.
2. It is stated that the petitioner is the pattadar and possessor of the agricultural land admeasuring Ac.O.O4 guntas in Sy.No. lO / Al6AlA, situated at Khanapur Village, Gandipet Mandal, Ranga Reddy, having purchased the same through registered sale deed bearing document No.526 of 2023, dated
26.12.2023. It is further stated that the name of the petitioner was incorporated in all the revenue records and she was also issued pattadar passbook bearing No.T05070O20523 under the provisions of the 'lelangana Rights in Land and paLtadar Passbooks Act,2O2O (for short "the Act 9 ot 2O2O"l. It is lurther st.ated that inspite of the said order, the Tahsildar dicl not conrluct the survey, the petitioner h:Ld submittecl application for appeals on demarcation, dated 23 .06.2025 to conduct the strb-division survey and demarcation of the subject land by fixing boundary stones. The grievance of the petitioner is that even afLer receiving the said application, the respondent authoritie s did not consider the said application.

Considered the submissions of the learned <:ounsel for the petitioner, learned AssisLant Government pleader for Revenue appcaringl for the respondents and with their consent, this writ petition is; being disposed of at thc admission stag,r. J CVBR. J Wp_1E575_2025 4 . Learned counsel for the petitioner has submitted that in terms of the circular issued by the Commissioner, Survey, Settlements and Land Records, the respondents are bound to consider the application within 45 days from the date of the application after collecting necessary charges.

Learned Assistant Government Pleader for Revenue appearing for the respondents has submitted that the responden t authorities will consider the aforesaid application submrtted by the petitioner by following due procedure laid down undcr law and conduct survey and demarcate the subject land by hxing boundaries.

It is settled law that the Survey Department has the authority to conduct survey and demarcate lands in accordance with the provisions of the Telangana Land Revenue Act, 1317 Fasli (Act No. VIII of 1317 Fasli), the Telangana Survey and Boundaries Act, 1923, and the Rules framed thereunder. The Government has issued various circulars specifying the conditions for conducting surveys, particularly F-Line (held measurement) surveys. Individuals requesting such surveys are required to submit specihc documents, and if the conditions stipulated in the circulars are fulfilled, the survey ald boundary 4 CVBR, J VIp 18575 2025 't hxation may be conducted. The Commissioner, Survey, Settlements and Land Records, exercising po\/ers under the Telangana Surlcy and Boundarics Act, 1923, issued relevant circulars lrom time to time vidc Rc.No.Nl,/6543199, dated
25.O7.2OO,, Rc.No.N1/I4O8l07, dated t3.O7.2OO7, and Rc.No.N2/ 1741l2OlO, datcd 18.05.2010 stiFul.rting the conditions for conducting survey of private lands a'rd as per the said circulars, if the petitioner fulfils al1 the con<litions of the said circular, it is an obligation lor the responden ts to conduct survey witltin the time spccified in the said circulars.

In vrew ol the aforesaid discussion, this Court deems it appropriate Lo disposc of this writ petition directir g respondent No.2 to examine thc petitioner's application fo' erppeals on demarcatir>n uide No.AODO2250OO72785, datec 23.06.2025 submitted for conducting survcy and demarcatLon by fixing boundary stones to the petitioner's land to an ext{'nt ol-Ac.0.O4 guntas in Sy.No.lO/Al6A/A, situated at Khanapur Village, Gandipet Mandal, Ranga Reddy and if the petitioner fulfils all the condLtions mentioned in the circulars issued by the Ccjmmissicner, Survey, Settlements and Land Records from time to tirne, after issuing notices to all the pers,)ns interested and adjacent pattadars and after considering thcir objections, I 5 CVBR. J Wp_1857s 2025 respondent No.2 shall conduct survey of the aforesaid land, within a period of eight (8) weeks from the date of receipt of a copy of this order. It is needless to observe that in the event if the sub-divisional records have to be prepared for the survey numbers of the subject land, respondent No.2 is directed to prepare the sub-divisional survey numbers for the survey numbers of the subject land, subject to petit.ioner paying all the incidental expenditure for preparation of the sub-divisional records.
8. With the above observations, this Writ petition is disposed of. There shall be no order as to costs.
