With the consent of learned counsel appearing for the parties, the Writ Petition is taken up for hearing and disposal at admission stage.

2. Having regard to the nature of /rs involved in the Writ petition and the manner of disposal, this Court is of the view that notice to unofficial respondents is not necessary for adjudication of the present Writ Petition

3. The casc of thc petitioners in brief is that respondent Nos.5 and 6 are harassing the petitioners, physically assauliing them at their home and interlering rvith their possession and with the construction activity being under-taken by thern without following due process of law, which action o l' the respondent authorities, it is contended as highty iltegal and arbitrary.

4. Per contra,leaned Govemment Pleader for. Home appearing on behalf of respondent Nos. I to 6 u,t.rile denying the Writ avennents has 2 placed before this Court the written instructions under the signature of the Sub-Inspector of police, Gachibowli police Station, Cyberabad Comrnissionerate dated 01 _07 _2025. ..1

By the written instructions, it is stated that based on the complaint/representation of the gth respondent, the authorities have registered a case vide Cr.No.ll4g/2024 under Secrion 406, 420 IpC against the 1't petitioner herein and another and took up investigation thcrcin. 6 By the written instructions, it is further state that during the course of investigation, the Investigating Officer examined and recorded the statement of complainant and collected documentary evidence.

7. It is also stated that as per th.e evidence collected and investigation conducted so far, prima facie case has been established against the petitioner/A_l along with other accused.

8. By the written instructions, it is further stated that the Investigating Officer tried to issue notice under Section 41 Cr.p.C. to the l'' petitioner herein, but he did not choose to cooperate and filed the present Writ petition leveling false allegations. 3

9. By the written instructions, respondent authorities futher claim that the 5th respondent herein never harassed, physicalty assaulted and interfered with the 1" petitioner's possession over his residence and construction site and that respondent Nos.5 and 6 are discharging their legitimate duties and did not harass, assault or interfere with petitioners' life and liberty or civil disputes nor taken any coercive steps agarnst petlttoners ln any manner

The aforesaid submissions made by the respondent authorities under the written instructions as placed before this Court are taken on record 1 1. ln view of the submissions made as above on behalf of the respondent authorities whereby it is stated that the respondent authorities except conducting investigation into Cr.No.1 148/2024 dated 22-07 -2024 wherein the l" petitioner herein is arrayed Accused No.l along with one Nikhil u,ho is arayed as accused No.2, this Court is of the view that the rcspondent authorities while conducting investigation into the aforesaid crime registered, are to be directed not to interfere with the life and liberty of petitioner Nos.2 and 3 as it is stated that they are not anayed as accused in the aforesaid till date, and in the event of respondent authorities intend to take action against t t I t I 4 the petitioners, the respondent authorities are further directed to follow due process of law

12. Subject to above observation and direction, the Writ Petition is disposed of. No costs.
