The petitioner is arrayed as accused No.2 in the above C.C. which was taken cognizance for the offences punishable under sections 420 and 406 read with 34 of the lndian penal Code, 1g60 (for short ,lpC,). 3. Heard IVr. tVlohd. Adnan, learned counsel for the petitioner, Mr'Jithender Rao Veeramara, rearned Additionar pubric prosecutor, representing respondent No..l-State and f\4s.Niloufer Afshan, learned counsel for responden t No.2ldeJacto complainant.
4. Pending this petition, the parties have entered into the compromise and, accordingry, respondent No.2lde-facto comprainant filed l.A.Nos.3 and 4 of 2025 with the prayer to permit them to enter into "orprffiii" and by recording the setflement to quash the proceedings against the _petitione. r/accused No.2 in C.C.No.1 1999 of 2021 J 2

Having considered the allegations' the nature of charged offence i.e. Section 420 aod406 IPC' alleged against the petitioner/accused No'2 and taking into account the amicable settlement between the parties and to restore peace between the parties' in the light of the dictums in Gian Singh v- State of Puniab and anothey' and Anit Mishra v' State of u.P.2i State of Madhya Pradesh v' Laxmi Narayan and others3' this Court is of the considered view that quashment of the impugned proceedings in view of the settlement by exercising jurisdiction under Section 482 Cr'P'C't528 of BNSS' 2023' would be in the interest of l-uslioe | 2012 (1o) scc 303 'z 2oz4 INSC 189 3 zo19 (5) scc 688 3 B. Accordingly, l.A.Nos.3 and 4 of 2O2S are allowed. Consequenfly, all the proceedings against the petitioner/accused No.2 in C.C.No.119g9 of 2021 on the file of the XVll Additional Metropolitan Magistrate.
