Learned counsel for petitioner submitted that the petitioner is nothing to do with the alleged offences The present criminal case was filed as a counter-blast to the Crime No 36 of 2019, which was registered as C.C.No.269 of 2019 wherein the petitioner herein is the de-facto complainant and the respondent No.2 herein is shown as accused and the same is pending for adjudication. There was suppression of material facts by the respondent No.2. All the allegations pertain to civil dispute in respect of parking and utilization of common passage road' Therefore, he prayed this Court to quash the proceedings against petitioner-accusedbyallowingthisCriminalPetitionFurther'itis submitted that the learned trial Court had commenced the trial and the same is under Progress

On the other hand, learned Additional Public Prosecutor appearing for the State as well as learned counsel for respondent No.2 contended that it is not a fit case to quash the \ \ in. .J proceedings against petitioner at this juncture and the matt3r is to be decided after conducting trial by the Court below and prilyed to dismiss this Crinrinal Petition

Learned counsel for both sides submitted that the trial is ir active progress before the learned trial Court.
