SUJANA TRANSFER CRIMINAL PETITION NO.57 OF 2025 ORDER: This transfer criminal petition is hled by the petitioners/A. 1 to A.7 seeking transfer of C.C.No.S18 of 2023 from the file of Principal Junior Civil Judge-cum-Judicial First Clzrss Magistrate at Miryalaguda to the Court of VI Additional Junior Civil Judge cum-Judicial First Class Magistrate at l-.B. Nagar, Ranga Reddy District.

2. Heard Sri Gajanand Chakravarthy, learned counsel for petilioners and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for respondent No. 1-State.

3. Learned counsel for the petitioners would submit that petitioner Nos.2 to 7 have filed quash petition before this Court and the same was allowed. As such, the transfer criminal pelition against petitioner Nos.2 to 7 is not pressed.

4. The contention of learned counsel for petitioner No.1 is [hat petitioner No. I and respondent No.1 are husband and wife. The respondent No.l hted C.C.No.S 78 of 2023 on the h1e of Principal .Junior Civil Judge-cum-Judicial First Class Magistrate 2 at Mrryalaguda. Thc respondent No.1 also filed rv .C.No.29 of 2O2l on the lile of Family Court, Ranga Reddy t istrict. The petitioner No.1 herein filed petition seeking -ransfer of D.V.C.No. 14 ot 2023 from thc hle of Principal . unior Civil Judge-cum-Judicial First Class Magistrate at Miryr aguda Vide Tr.CRL.P.No.96 ol 2024. The same was allowed ar< thc D.V.C, was translerrecl to VI Additional Junior Civil , udge-Cum- Judicial F'irsl Class Magistratt: , Ranga Reddy District at L.B.Nagar. The respondent No.1 filed Tr.C.M.P.r! )s.431 and 394 of 2022 to transfer O.P.No.267 of 2O2I and F.(l O.P.No.764 of 2O2O lrom the Court ol Additional Family Court. i lnga Reddy District at L. B. Nagar to Senior Civil Judge, \ iryalaguda, Nalgonda District but thc same \ .as dismissed b1' this Court. Now all the cascs are pending bcfore Ranga Reddl' I ourt except C.C.No.518 ol 2023. He further contended that everr respondent No. t herein filecl M.C. case in Ranga Reddy Court ,r hich shou,s that she is also rcsiding in Hyde rabad. As such, i - -he present C.C., is also translerred to Ranga Reddy Courr , it will be convenient to both parties. As such, requested t: s Court to transfer C.C.No.S18 of 2023 from Miryalaguda (] rurt to Vi- Additional Junior Civil Judge cum-Judicial l rst Class Magistrate at L. B. Nagar- 3

5. Proof of service of notice on respondent No.1 filed by the petitioner would show that notice is served on respondent No.1 but there is no representation on her behalf.

Considering the submissions made by the learned counsel for the petitioner and as seen from record, the earlier transfer criminal petition filed by the petitioner for transfer of DVC case r,,.as already transferred Lo the Court of VI Additional Junior Civil Judge cum-Judicial First Ciass Magistrate, Ranga Reddy District at L.B.Nagar, and the only case pending at Miryalaguda is the present C.C.No.518 of 2023. Considering all these aspects, this Court decms it appropriate to transfer C.C.No.51g of 2023 from the file of principal Junior Civit Judge_cum_ Judicial First Class Magistrate at Miryalaguda to the Court of VI Additional Junior Civil Judge cum-Judicial First Class Magistrate at L.B.Nagar, Ranga Reddy District.

Accordingly this Transfer Criminal petition is allowed and C.C.No.S18 of 2023 is r.r,ithdrawn and stands transferred from the Court of Principal .Junior Civil Judge-cum-Judicial F.irst Class Magistrate aL Miryalaguda to the Court of VI Additional Junior Civil Judge-cum Judicial First Class Magistrate at L.B.Nagar, Ranga Rcdd1,' District wherein the DVC case is 4 pending. The Court concerned is hcrcby directed to t ansmit the entire case file relating to C.C.No.518 ol 2O2-z alter duly indexed, within a pcriod of Onc ( i ) month from he date of receipt of a copy of this Order, under intimation r, the other side.
