No.18419 of 2o25 This writ petition is liled seeking to declare the action of the respondent No.2, Regional Passport Ofhcer, in not renewing petitioncr's Passport bearing No.K4168055 pursuant to the application vide File No.HY 1074122854122 dated 13.O4.2O22 on the ground of pending criminal cases, as illegal and arbitrary and consequently to direct the respondent No.2 to renew petitioner's Passport.

It appears from the impugned orde r dated 24 .O2.2025, the petitioner made an application vide Fiie No.HY 1O74122a54I22 dated 13.04.2022 seekir-rg for renewal of his Passport and considering the same, the respondent No.2 has passed impugned refusal order dated 24.02.2025 whcrein and whereby the petitioner was informed in view of pending Criminal Proceedings vide S.C. t No.7OO2a4 l2O2 1, FIR 573/21, 1323/21 in the Court of III MM, L-8. Nagar and XII ACMM, Nampally and the office can reconsider the petitioner's application, if the petitioner submits acquittal orders or obtain permission to travel abroad from the same Court where the criminal proceedings are still pending

3. Learned counsel for the petitioner would submit this Court, taking into consideration the principle laid down by the Hon'ble Supremb -Qourt in Vangala kasturi Rangacharyulu Vs. Central 2 NVS(, J W P No 18419 ot2O2a Bureau of Investigationl, disposed of several rvrrt petiLions rvith certain conc itions and sought Lo pass similar order.

4. On th: other hand, the learned Standing Cou:rsel appearing for the respond :nts does not drspute the same.

I{avin 3 considered the submissions made by the learned counsel on either side and with their consent, this writ petition is disposed of ,vith the following conditions: (i) (ii) (iii) The petitioner shall submit an undertaking along with an affidavit before the VII Special S,:ssions Judge for Trial of Cases under SCs/STs (F'OA) Act-cum-VII Additional District and Sessions Judge, Rangareddy District at L.B. Nagar, in S.C. No.70O244 of 2027 (Crime No.573 of 2O2l), stating that the petitioner will not leave India during pendency of the said S.C. without permission of the Court and the petitioner will cooperate with the Trial Court ir. boncluding the criminal proceedings. The Trial Court shall issue a certihed copy of the undertaking along with an affidavit within Two (2) weeks from the date of hling of the unclertaking. The petitioner shall submit the certihed copy of the aforesaid undertaking along with the reply/explanation before the concerned Passport Officer for consideration of his application for renewal of passport. The petitioner shall also be at liberty to rely on the decisions in this regard. The Passport aulhority is directed to renew the passport of the petitioner without raising the objection relating to the pendency of the criminal proceedings before the Trial Court. ) l (vi) The petitioner shall deposit the original passport before (vii) the VII Special Sessions Judge for Trial of Cases under SCs/STs (POA) Act-cum-VII Additional District and Sessions Judge, Rangareddy District at L.B. Nagar, in S.C. No.7OO244 ol 2O2l (Crime No.573 of 20211, after renewai of the passport. The petitioner shall be at liberty to file an application before the VII Special Sessions Judge for Trial of Cases under SCs/STs (POA) Act-cum-VII Additional District and Sessions Judge, Rangareddy J,u,.t", at L.B. Nagar, in S.C. No.700244 of 2O2l (Crime No.573 of 2021), seeking permission to travel ourside India. The VII Special Sessions Judge for Trial of Cases under SCs/STs (POA) Act-cum-VII Additional District and Sessions Judge, Rangareddy District at L.B. Nagar, shall consider the same in accordance with law.
