SRINIVASA RAO SC FOR GHMC The Court made the following: ORDER THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY WRIT PETITION No.18O66 of 2025 ORDER: Thls writ petition is filed seeking following relief "For the reasons stated in the accompanying afhdavit, the petrtioner herein prays that this Hontrle Court may be pleased to issue a order or direction more particularly one in the nature of Wrlt of Mandamus, declaring .the action of the respondents in interfering with the peaceful possession and enjoyment of the petitioners residential flats situated at Nandanavanam Colony, TKR Coltege Road, Kharmanghat, Saroornagar, Ranga Reddy Dist., without following due process of law as illegal, arbitrary and violation of principle of nature jusrice and pass such other order or orders as this Hontrle Court deems fit and proper in the circumstance of the case-"

2. It is stated that the petitioners belong to scheduled castes, scheduled tribes, minorities and are below poverty line. It is further stated that the petitioners have constructed huts at Nandanavanam/Adarshnagar Colony, Saroornagar Mandal, Ranga Reddy District and residing in the said huts since more than 15 years and eking out livelihood working as agriculture coolies and other allied works- It is further stated that on the assurance given by the respondent authorities, the petitioners vacated the premises in their possession to enable the Government to construct pucca houses as per the policy enunciated by the Government time to time and constnrction work has taken up accordingly in the year 2012 and for the reasons best known to the Government, the said construction work has not been completed. It is further stated that on the instructions of the revenue officials, the petitioners occupied the incomplete and unfinished houses and residing in the said houses by paying electricity charges and other charges. It is further stated that the respondent authorities at the instance of the political hierarchy to allot the said houses in occupation of the petitioners to 2 CVBR, J W.P.No. 18066 of 2025 the persons of their choice, ma<_le efforts to dispossess the petitioners without issuing any notice or opportunity of hearing. Hence, the present writ petition.

3. Considered the submissions of the learned counsel for the petitioners and sri L. Ravinder, leilrned Assistant Government Pleader for Revenue appearing for respondent Nos.1, 2,4 and 5 and perused the record'

From the reading of the affidavit Iiled in support of the petition, it is seen that except making the above said allegations, the petitioners have not enclosed any documents ''6f either power supply connection or water supply connection for establishing their possession over the subject property and the house numbers assigned for the said houses and the assessment tax being collected by the Municipal Corporation. Unless the petitioners furnish the above said particulars, it cannot be presumed that the petitioners are in occupation of the residential flats since long time and they are entitled for grant o[ house sit(] pattas. Therefore, this Court is of the pimia facie opinion that since the Petitioners have not fi1ed any document in support of their case, this Court is not inclined to grant any interim order directing the respondent authorities not to interfere with the possession of the petitioners in respect ol- the residential flats situated at Nand.anavanam/Adarshnagar Colony, Saroornagar Mandal, Ranga Reddy District. 7I 3 CVBR, J W.P.No.18O66 of 2O25

5. In the decision reported in Olga Tellis v. Bombay Municipal Corporationr, the Hon'ble Apex Court treld that under Artir;le 39(a) of the constitution of India, which is a Dlrective principle of state policy, provides that the State shall, in particular, direct its po[cy towards securing that the citizens, men and women equally, have the right to an adequate means of livelihood. Therefore, in view of the above said decision, duty is cast upon the respondent authorities to provide basic necessities to the citizens

6. In view of the aforesaid discussion and in vieu, of the decision of the Hon'ble Apex court in otga. Tellis case (supra) , since the petitioners stated that they belong to be,low poverty line and they are in occupation of the residential flats situated at Nandanavanam/Adarshnagar Colony, Saroornagar Mandal, Ranga Reddy District since long time, this Court, without expressing any opinion on the right and entitlement of the petitioners for sanction of house site pattas, deems it appropriate to dispose of this writ petition directing respondent eruthorities to examine the claims of the petitioners, if they satisfy all the requirements for sanction of the house site pattas and consider their case in accordance with law.
