Petition Under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may :[s pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondents in not paying the Minimum regular time scale in the Last Grade service to the petitioner under the principles of Equal pay, Equal work as per the Judgment of the Hon'ble Supreme Court reported in 2017(1) SCC148 in the state of Punjab and others Verses Jagjit singh and others as illegal, arbitrary and Un-constitutional and consequently direct the respondents to pay the 7th Minimum regular time scale in the Last Grade service to the petitioner under the principles of Equal pay, Equal work as per the Judgment of the Hon'ble Supreme Court'reported in2O1l(1) SCC 148 in the state of Punjab and others Verses Jagjit singh with all incidental and consequential benefits duly taking into consideration the length of service put by the petitioner. 10F 1 Petition Under Section 151 CPC praying that in the circumstances stated in the affidavit filerd in support of the petition, the High court may be pleased to direct the respondenl: to pay the Minimum regular time scale in the Last Grade service to the petitioners as per the Judgment of the Hon'ble Supreme Court reported in 2017(1) SCC 148 in the state of Punjab and others Verses Jagjit singh case pending dispos;al of the above writ petition. The petitioner served continuously in sanctioned posts in Raganraguda and later Kammaguda Gram panchayats, with periodir: salary enhancements. ii) After the Kammaguda Gram panchayat was merged into Turkayamjal Municipality, the petitioner's services were taken over by the Municipality from 02.08.2018. The petitioner has , r' .{ 3 SN, J wp_19132 2019 continuously worked for over 25 years in a sanctioned post and was treated as a regular employee. iii) The petitioner submitted a representation to the respondent No.3 dated 24.10.2018 seeking payment of minimum time scale as per the petitioner's post, however, no action had been taken by the respondent No.3 and the petitioner has not been paid salary since the merger. Aggrieved by the same, the petitioner filed the present writ petition.

PERUSED THE RECORD:- (A) This Court passed orders dated O9.O9.2O19 in is extracted hereunder: "...Petitioner is working as Bill Collector in Turkayamjal Municipality. ln view of the principle laid down by the Hon'ble Supreme Court in State of Punjab and others v. Jagjit Singh and others reported in 2OL7 (1) SCC 148, even the full time employee is entitled to payment of minimum time scale of pay, attached to the post. By way of interim order, the respondents are directed to pay minimum time scale of pay attached to the post of Bill Collector." 4 SN, J wp_19132_2019
5. Learned standing counsel appearing on behalf of the respondent No.1 submits that the order of this Court dated 09.O9.2019 passed in I.A. No. 1 of 2O19 had been duly implemented vide proc. No. Cllt2tl2OZO dated the Commissioner, Turkayamjal 22.06.202lJ Municipality and it had been resotved to pay the salaries of the petitioner, in the minimum time scale attached to the post of Bill Collector with effect from Juty 2018, and accordingly, the individual pay had been fixedby the sth respondent vide proceedings dated OL.O4.2.O22 in Proc. No. C1l192 12022. Hence, the prayer as sought for by the petitioner in the present writ petition had already been granted.

Lerarned counsel appearing on behalf of the petitioner does not dispute the said submission made by the learned standing counsel appearing on behalf of the respondent No.1. 7 n n ! n ! /,/ To SA TKS N 5 SN, J wp-19132_20t9 closed.
