BHASKAR REDDY WRIT PETITION No.18165 of20.25 ORDER: This writ petition is filed seeking following reliet "...to issue an order or direction more palticulady one in the nature of writ of mandamus or any ottler appropriate writ declaring the action of the respondent authorities in not conducting the survey of the land and not fixing the boundaries to the larld of the petitioners i.e., the land admeasuring Ac. 1.O7 gts., in Sy.No. 183 and A<:- 1 .37 gts., in Sy.No.193, totaling to Ac.3.04 gts., situated at Koheda Village, Hayathnagar Mandal, Ranga Reddy District, even though the said authorities received the F- Line applications along wittr requisite fee on 12.09.2023 through application No.DER022300997672 on 12.09.2023 and DER0223OO997672, is nothing t'ut arbitrary, illegat, null and void and violative of principles of natural justice and also violative of Article 14, 19 and 21 of the Constitution of India and a-lso the provisions of sections 89, 89A and 92 of the Andhra Pradesh Telangana area Land Revenue Act and the circulars issued in this regard, Consequently direct the respondent authorities to conduct the survey and lx the boundaries of above land of the petitioners i.e., the land admeasuring Ac.1.07 91s., in Sy.No. 183 and Ac.1 .37 gts., in Sy.No. 193, totaling to Ac.3.04 gts., situated at Koheda Viltage, Hayathnagar Mandal, Ranga Reddy District considering the F-L:ne applications submitted by the petitioners dat.ed 72-09 -2023 along with requisite fee.-."

It is stated that one andala Mohan Reddy was the pattadar of the land Ac.1.O7 gts., in Sy.No. 183 and Ac.1.37 gts.. in Sy.No.193, totalling to Ac.3.04 gts., situated at Koheda Village, Hayathnagar Mandal, Ranga Reddy District and he made the said land into plots and the petitioners herein have purchased the said plots through registered sale deeds. It is further stated that when the 2 C!tsR, J Wp_18165 2025 neighbouring land owners have started disturbing the possession of the petitioners, they have made F-Line applications, dated
12.09.2023 for conducting survey and demarcation of the land admeasuring Acs.3.04 guntas in Sy.No.lg3 and 193 situated at Koheda Village, Hayathnagar Mandal, Ranga Reddy District. The grievance of the petitioners is that even after receipt of the said application, the respondent authorities did not consider the same.
3. Considered the submissions of the learned counsel for the petitioners and Sri L.Ravinder, learned Assistant Government Pleader for Revenue appearing for the respondents and with their consent, this writ petition is being disposed of at the admission stage.
4. A careful examination of the sale deeds of the petitioners revealed that the petitioners have purchased open plots located in schedule property. It is not the case of the petitioners that the plots purchased by them are agricultural lands and that they paid stamp dut5r or registration fees on acre basis. The schedule of property in the sale deeds establishes that the nature of the property is open plots. It is settled law that the Survey Department has the authority to conduct survey and demarcate lands in accordance with the provisions ofthe Telangana l,and Revenue Act, 3 CVBR, J Wp_18165 2025 1317 Fasli (Act No. WII of 1317 Fasli), the Telangana Survey and Boundaries Act, 1923, and the Rules framed the:reunder' The Government has issued various circulars specirying the conditions for conducting surveys, particularly F-Line (freld rneasurement) surveys. Individuals requesting such surveys are required to submit specihc documents, and if the conditions stipulated in the circulars are fulfilled, the survey and boundary fx:'tion may be conducted. The Commissioner, Survey, Settlements, and Land Records, exercising powers under the Telangana Survey and Boundaries Act, 1923, issued relevant circulars frorrr time to time vide Rc.No.Nl 16543199, dated 25.07.2001, Rc'No Nl I I4O8/07, d,ated. 13.O7.2007, and Rc.No.N2/174ll2OlO, dated 18'05'2O10 stipulating the condilions for conducting survey of private lalds' The said Circulars outline that only agricultural lan'ls are eligible for survey by the Survey Department. In contrast, individuals owning plots within approved layouts, municipalities, Gram Panchayats, or Municipal CorporaLions are required to engage Licensed Surveyors appointed by the Government for such surveys, as these lands are no longer considered agricultural. In the instant case, the petitioners' lands are clearly identifred as open plots but not agricultural land. Since the petitioners' properties are not agricultural land, the Survey Department has no .furisdiction to 4 CVBR, J Wp_l8165_2025 conduct F-Line Survey as per the Circulars issued by the Commissioner, Survey, Settlements, and l,and Records. For the aforesaid reasons, this Writ Petition is devoid of merits and is liable to be dismissed.
5. Accordingly, this Writ Petition is dismissed. However, the petitioners are at libert5r to take the services of licensed surveyor U: for conducting the survey of their property i.e, open plots, if they are so advised.
