ORDER:
This Criminal Petition under Section 482 Cr.P.C. is filed by the petitioner S. Sudhakar Reddy, accused, seeking to quash the proceedings against him in C.C. No.792 of 2006 on the file of Additional Judicial Magistrate of First Class, Kurnool, [ Crime No.253 of 2004 of Two Town Police Station, Kurnool District ] filed by his wife Smt. M. Satyakumari, respondent No.1 herein, for the offences under Sections 498-A, 324 & 506 IPC and 3 & 4 of Dowry Prohibition Act,

Based on the allegations made in the complaint, definitely there is prima facie case against the petitioner. Maybe the police earlier reported the case as false, but on that sole ground it cannot be held that there is no prima facie case against the petitioner. The entire questions raised are questions of fact and it is not desirable to discuss the merits of the case at this stage. Suffice it to say that there is prima facie case against the petitioner, as such, there are no grounds to quash the proceedings against him.
