It is stated that the petitioner paid an amount of Rs'1,63,9991- rtrrough a Rank challan uid"e challan No.[ATRN]8369O52861025 dated 26.05.2022 in State Bank of India, Peerzadrguda B.ranch, for the purp<)se of registration of a Gift Deed in favour of the petitioner, but however' the property o[ the petitioner was kept in the list of prohibited properties list on the groupcl that civil suit is pending against the petitioner' The grievance of tfre petitioner is that she submitted a representation dated 28'05'2025 to the Jrrt respondellt requesting to refund the Bank challan amount of Rs.1,63,999/- $'hich rnas paid by :her uide challan No-[ATRN18369O52861025 datecl 2€t.Oc.2022 and. to credit the same to ttrc petitioner's Bank Account No.2OO9O 75669(t, but till date the said re presentation has t-tot bee n considercrd b1, tl-re ?r<l respondent. 3. Considered the submissions of the learned counsel for the petitioner, lcarnccl Assistant Government Pleader for Revenue appearing for respondent Nos. I and 2 and learned Assistant Government Pleader for Stamps ancl Rcgistratior-r appearing for respondenl No.3 and with thcir consent, this u,rit pctition is disposed of at the admission stage.

4. Lcartrcd counscl for the petitioner vehe'mently contended that once the do<:umcnts submitted by the petitioner are not processed for registration, lhc pctitioncr is entitled for the refund of the stamp duty and registration [r'cs.

[t is not in dispute that when the documents submitted by the petitioner at c no[ pt'occssed for registration undcr the provisions of the Registratiott Act,, 190c3, Lhcn the amount deposited towards the stamp duty or the registrzrtion cherrgc's arc liable to be returned. Admittedly, in the present writ pctition, rvhe n thc propertv which the petitioner sought to register by way of a Gitt Dci:d is listed in the prohibited properties list, the respondent authorities cvclt bcforc collcction of the stamp duty, ought to have informed to thc pctitior-rcr- that lhc said property is listcd under the prohibited propel'ties list.
