Judgment
HONOURABLE SRI JUSTICE N.RAVI SHANKAR CRIMINAL PETITION No.5992 of 2011 ORDER: Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.
The allegations in the F.I.R. do show the offences punishable under Sections 120B, 448, 384, 452 and 506 I.P.C. read with 34 I.P.C. The mater is pending investigation.
The learned counsel for the petitioner who is stated to be A.4 in the case has argued that the petitioner is a practicing lawyer and he has been described as a person doing tent house business and that the other accused in the case are his clients and the opposite party has foisted this case.
The above contentions and other pleas raised fall within the purview of the disputed questions of fact and they cannot be decided by this Court in this petition. Hence, the relief for quashing F.I.R. is rejected.
As it is reported that the petitioner is a practicing advocate, the concerned police may strictly keep in view section 41 Cr.P.C. in taking a decision about his arrest.
