Learned counsel for the petitioncrs submits as follou's: That the then State of Andhra l)radesl-r Police Recruitment Board, Hyderabacl, issued recruitmcnt Notification, dated 18.12.2OO3 lor filiing up thc posts of Stipendiary Cadet Trainee Police Constables in Civil, A.P,S.P and A.R. in all the Districts, duly inviting applications lor recruitment. On 28.01.2OO4. the candidatcs were asked to 2 appear .,vith required documents before the notified authorities.

Alier publication of the provisional Selection List on '21 .O8.2OO4 , lhe Chairman of the Police Recruitme nt Board, issued a Mcmo on 23.08.2OO4 for sending the petitioners lcrr training. ln spite of that, for a period of three months, no action has been taken by the concerned Commandarrts lor sending the candidates for training. On 17 .11 .2004, administratir/e orders were issued for undergoing training for a period of () months. Accordingly, the petitioners werc seltt lor training crn 16.11.2OO4 and L7.1I.2004 respectively and successfullv completed training. Thereafter, the petitioners r.r,ere appointed duly counting the entire training period for the purpos€: o[ all other benefits. 3

5. The Contributory Pension Scheme w,as introduced by the then Government of Andhra Pradesh rr ith effect from

It is Provided that ;r-ll new emplo,vees "who are recruited on or after OI.O9.2OO4" are to become members of thc schcme. 'l'he employees wili pay monthly contribution ol 1O'li' of thc lrasic pay and DA from their salar5r to the Contributory Pensiotr Sche me.

6. Thc petitioners were sent on training after 01.09.2004 thinking that they would be treated under Contributory Pension Scheme. The petitioners made reprcsentations to the Dircctor Ceneral of Police and the Govcrnmcnl - Thc Dircctor Gerreral of Police, in Lr.No.L2/34766 l20 l6:, dated 18.05.20 16 submitted proposals for consideration of pctitioners' CASCS under Old Pension Scheme (Revised Pension Schcnrc ol 1980) and given valid reasons for extending the said ber-refit. Thc Dircctor Genera-l of Police recommended that issuzurce of Notification and existence of vacancies is to be taken into account for the purpose of extending Old Pension Rulcs anci thereby, the petitioners can be continued under Old Pension 4 Rules anrl t hercb_r, petitioners can be continued undcr Old Pensi<>n Ilrlc's, rather- than applying new Pcns:on Scheme . 7 . Therefore, the Revised Pension Rulcs, l9BO uhich ra,ere existing as on the date of issuance of thc Notification, ar-e only to be taken into account rather than tfie Ncr, Contributory Pension Scheme.
