Venkat Raman, learned counsel alrpearing on behalf of petitioners and Sri P.Sri Harsha Reddy, learned Standing Counsel for Singareni Collieries Company Limited, appearing on behalf of respondent Nos.l to 5.

The petitioners approached the Court seeking prayer as under: "...to pass a writ order or direction more particularly one in the nature of writ of Mandamus declaring that the action of the respondents in not considering the cases of the petitioners in respect of posting them, as Category-I Motor Mechanic (Trainee) (External), as per their merit, published in final merit list, dated 24-05-2017 issued by the 3'd respondent as illegal, arbitrary, unjust, contrary to circulars and office memorandums issued by the 1't respondent-company violative of principles of natural justice, violative of Articles 14, 16 and 27 of the Constitution of India and u nconstitutiona I and consequently to direct the respondents to consider and dispose of the representation dated 03-08-2018 made by the petitioners, in respect of posting them as Category-I Motor Mechanic (Trainee) (External), as per their merit published in final , , - ,J-: a ..i. . ii >,, ;: .3"j&, a,'.,.&,ta , 2 SN, J wP 2071t 2020 merit list dated,24-05-2017 issued by the 3'd respondent and to pass...",

The case of the petitioners, in brief, is that in pursuance to the NotiFication No.2 of 2015 issued by the respondents calliiig applications for recruitment to the post of Category-I Motor Mechanics (Trainee) (External), the names of the petitioners were displa'yed at Serial Nos.12, 19,21,22,26 and 35 respectfully n the successfully completed list as the eligible and qualified candidates. However, while issuing posting orders, the petitioners urere given posting orders to various adjusting places, which is contrary to the notiFication. The petitioners made a representation dated 07.05.2018 to the 4th respondent and the respondent No.4 in his letter dated 11.06.2018 explained the reasons for issuing diFferent posting places. The petitioners made another representation dated 03.08.2018 to the 1st responde nt-com pa ny to consider their grievance. However, the respondents did not consider the same. Aggrieved by the same, the petitioners filed the present writ petition. 4, The limited relief as sought for by the petitioners in the present writ petition is a direction to the respondents to consider the petitioners' representation dated 03.08.2018 in respect of , SN, J wP 207 2020 posting them as Category-I, Motor Mechanic (Trainee) (External) as per their merit, published in final merit list, dated 24'05'2077 issued by the 3'd resPondent.

Sri P.Sri Harsha Reddy, learned Standing Counsel for Singareni Collieries Company Limited, appearing on behalf of respondent Nos.1 to 5 submits that the petitioners are presently permanent employees oF the respondent-company and in view of the fact that the petitioners had already represented their grievance through representatlon dated 03'08'2018, the respondents may be directed to consider the same within a stipulated Period. 6, Takinq into consideration : (a) The facts and circumstances of the case, (b) The submissions made by the learned counsel appearing on behalf of the petitaoners and the learned Standing Counsel appearing on behalf of respondents' (c) The contents of the petitioners' representation dated O3.08.2O18 made by the petitioners to the 1"t respondent herein with a request to post them as Category-I, Motor Mechanic (Trainee) (External) as per I I ';- 4 .
