Counsel for the Petitioner: SRI S.SRIDHAR Counsel for the Respondents: SRt L.RAVINDER, AGP FOR REVENUE The Court made the following: ORDER HON'BLE SRI JUSTICE C.V.BHASKAR REDDY WRIT PETITION No.l 6708 of 2025 ORDER: It is stated that petitioner No.1 is the absolute owner and possessor of agricultural land admeasuring Ac. 19.23 guntas in Sy.No.52/26 situated at Singavaram Viflage, Achampet Mandal, Nagar Kurnool District, having purchased the same through registered sale deed dated 29.O1.20O8 and petitioner No.2 is the absolute owner and possessor of agricultural land admeasuring Ac. 11.37 guntas in Sy.No.52/27 situated .at Singavaram Village, Achampet Mandal, Nagar Kurnool District, having purchased the same through registered sale deed dated 29.O|.2OOA. It is further stated that the petitioners, names were incorporated in the revenue records and pattadar passbooks were issued in their favour. It is further stated that with an intention to fix the boundary stones over the subject land, the petitioners have made an F-line application, dated 17 .O7 .2024 , in terms of the circulars issued by the Commissioner, Survey, Settlements and Land Records. The grievance of the petitioners is that even after receiving the said F-line application, the respondents are not conducting the survey and also not fixing the boundaries over the subject land. Sri L.Ravinder, learned Assistant Government Pleader lor Revenue appearing for the respondents has submitted that as per the circular instructions issued by the Commissioner, Survey, Settlements and Land Records uide Rc.No.Nl /6543/99, dated 25.07 .2OOi, Rc.No.N I ll4O8l07, dated l3'07 2O07, and Rc.No.N2/ 1741 l2OlO, dated 18.05.2010, the petitioners have to make F Line application seeking to conduct Field Measurement Survey before respondent No.S-Tahsildar. Instead of making F- Line application before the Tahsildar, who is competent authority to conduct survey as per the aforesaid circular instructions, the petitioners have straight away made the application for Appeals on Demarcation' If the person is aggrieved by the survey conducted by the Mandal Surveyor' may tile first appeal before the Revenue Divisional Officer and if a person is aggrieved by the survey conducted by the Deputy Inspector ol- Survey, he may hle second appeal before the Assistant Director of Survey and Land Records' Learned Assistant Government further submits that if the petil ioners hle F-Line application and the said application complies with all the requirements of the said circulars, the respondent authorities will consider the same.
3. - .ln vieu, of the said submissions and since it is the primary authority for conducting survey is Tahsildar-respondent No'5 as p8,E Lbe cir<;ular instructions, this Court deems it appropriate to 3 dispose of this writ petition relegating the petitioners to file F Line application, duly enclosing all the documents and land particulars, which are necessary for conducting survey before respondent No.5 and in the event of such an application being submitted by the petitioners and if the said application lulfils all the requirements mentioned in the Circular instructions issued by the Commissioner, Survey, Settlemcnts and Land Records from time to time, respondent No.5 shall conduct the survey, after issuing notices to all the persons interested and adjacent pattadars and after considering their objections and in any event, if the petitioners have not satisfied the prescribed conditions lor conducting survey over lhc subject land, respondent No.5 is directed to pass a reasoned order and communicate the same to the petitioners. The entire exercise shall be completed within a period ol eight (8) weeks from the date of receipt of such applipcation.
4. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
