2. Heard Mr. Bandi Sai Vamshi, learned counsel for the petitioners and Mr.Jithender Rao Veeramalla, 2 learnect Additional Public Prosecutor for respondent No.1-State.
3. Learned counsel for the petitioners seeks permission of this Court to withdraw the criminal petition. insofar as petitioner No.2/accused No.2 1S concerned, on the ground that the criminal petition was inadvertently filed seeking quashment of the proceedings, though the Investigating Officer has not fiIed anlr fina1 report against him.
4. In view of the submissions made by the learned counsel for the petitioners, criminal petition against petitionr:r No.2/accused No.2 is dismissed as withdrarvn.
5. Insofar as petitioner No.1 is concerned, though the a criminal petition was filed seeking to quash the proceedirrgs in C.C.No.6025 of 2025, the learned counsel for the petitioners restricted his prayer requestirrg this Court to dispense with the appearanca 3 of the petitioner No.1/ accused No. 1 in C.C.No.6O25 of 2025, on the lile of the VII Additional Chief Judicial Magistrate at Nampally, Hyderabad, in view of his age. 6. The learned Additional Public Prosecutor has not opposed the submission made by the learned counsel I I for petitioners.
7. In view of the above submissions, and without expressing any opinion on the merits of the case, the presence of the petitioner No.l/accused No. 1 in C.C.No.6O25 of 2025, on the file of the VII Additional Chief Judicial Magistrate at Nampally, Hyderabad, is dispensed with, subject to the condition that he shall be represented through his counsel on each and every date of hearing. If the presence of the petitioner is required a he shall appear before the trial Court. In case of his non-appear€rnce on tlre specific date fixed by the trial Court for his appearance, the trial Court is entitled to proceed with the matter, in accordance with law.
