Heard Mr.K.Venu Madhav, Iearned counsel for the petitioners, Mr.L.Ravinder, learned Assistant Government Pleader lor Revenue representing learned Government Pleader for Revenue appearing for respon.Je;rt Nos. I to 4 and Mr.Kondadi Aj ay Kumar, learned counsel for unoflicial respondent Nos.6 to 22.

Learned counsel for the petitioners submits that respondent No.3, in order to prevent public nuisance and to maintain peace and tralquility arnong general public, passed the impugned order in Case No.B4/ 1034 /2024 dated 21.06.2024 under Section 145 of Cr.P.C by imposing conditions in excavatin g/lifting/ taking the sald from Pedda Vaagu by the villagers of Jankampet Village instead of permitting the Jankampet villagers to lift/ excavate / take the sald from their village border of Pedda Vaagu ald the same is abuse of the powers vested in the authority
4. He further states that on 12.09.2024, the petitioners have submitted an application under Section 145(5) of Cr.P.C. before the Revenue Divisional Ofhcer, Armoor stating that, on
08.04.2024, both the parties were issued notices stating that there ft-as- a village border dispute at Jankampet Village and t7'', 3 Pacha-lnadkuda villages and that there u'as no rorder dispute between both the Villages. Stating thus. t re petitloners requested the authoritl' not to prevent th I villagers of Jankampet Village in excavating/ taking/ liftin5; sand from the border of their Jankampet village, Pedda Vagr artcl that the respondents and other villagers of Panchalnadl< rda village are already excavating/ taking/ iifting sand fronr thcir i'illage border.

He contends that respondent No.3 ougl-t - to lrave taken care of the welfare of the villagers of Jarrkamp et Village and the petitioners being the villagers of said Vil i ge are put to suffer hardship. He states that though the p t titioners have filed an application under Section ia5(5) of Cr . '.C. seeking to cancel the said order before respondent No.3 no action has been taken by respondent No.3 tili date. Hen: r. he seeks to set aside the impugned order

Opposing the sarne, learned counsel for unofficial respondent Nos.6 to 22 contends that the imp Lgned order is passed by respondent No.3 to protect put,l c peace arrd tranquillity. and indulgence of this Court, at tlr s stage is not warranted. Therefore, he seeks to dismiss the \v -it Petition ] 4 (
7. Learned Assistant Government Pleader for Revenue contends that the petitioners have hled an application under Section 145(5) before respo;rdent No.3 and hence, the cause in this Writ Petition does not survi'/e ior adjudication any further. Therefore, he seeks to dismiss the Writ Petition.

Having regard to the submissions of all the learned counsel, on perusal of the material available on record and upon considering the fact that the petitioners have already filed an application under Section 1a5(5) of Cr.P.C. before respondent No.3 and the same is pending consideration till date, this Court, without making any observations on the merits or demerits of the case, deems it appropriate to direct respondent No.3 to examine the case of the petitioners and pass appropriate orders, as expeditiously as possible, strictly in accordance with law, by issuing notices to all the interested parties including unofficia-l respondent Nos.6 to 22 and affording them sufficient opportunity of hearing. Since, notice is already directed upon unofficial respondent Nos.6 to 22, further service of notice on unofhcial respondent Nos'6 to 22 stands dispensed with 5 g .
