NO: 1 OF 201S(WPMP. KOPPULA GOPAL Counsel for the Respondent No.1: GP FOR MUNICIPAL ADMINISTRATION AND URBAN DEVELOPMENT Counsel for the Respondent No.2: GP FOR REVENUE Counsel for the Respondent No.3: SRI PUTTA KRISHNA REDDY, SC FOR MUNICIPALITIES Counsel for the Respondent No.4: GP FOR HOME The Gourt made the following: ORDER THE HON'BLE SRI JUSTICE LAXMI NARAYANA ALISIIETTY WRIT PETITION No.14817 of 2Ol5 ORDER: This writ petition is hled seeking following relief: "....declaring the action of the respondents herein in trying to dispossess the petitioners from their respective places in front of the shops situated at Vegetable Market, Vikarabad, Ranga Reddy District as illegal, arbitrary, unreasonable, violative of Articles 14 and 19 (1) (g) of the Constitution of India and contrary to the provisions contemplated under Municipalities".

2. Sri Koppula Gopal, learned counsel for the petitioners and Sri Putta Krishna Reddy, learned Standing Counsel for respondent No.3 are present.

3. Learned counsel for the petitioners would submit that petitioners are running vegetable market and eking out their livelihood; that government has constructed shops under Nehru Rojgar Yojana for vegetable vendors and allotted the petitioners and petitioners are running business from the allotted shops and rents are being paid regularly by the petitioners. He would further submit that while the matter stood thus, on 15.05.20 15, respondent No.3 along with respondent Nos.2 and 4 and their staff came to the market premises and threatened to dispossess the petitioners from their premises without any notice, without following any due process and thus, prays to allow the writ petition. I

Learned Standing Counsel for respondent No.3 would subriia O{ : that previously the Municipality has contemplated a development plan with an intention to construct new blocks and requested the petitioner to vacate the premises temporarily with an assurance that shops will be allotted to the petitioners in the newly constructed block. He would further submit that proposed development plan has been put on hold and thus, apprehensions of the petitioners are misconceived and therefore, the writ petition is liable to be dismissed. He would further submit that in case if respondents intend to proceed with the construction of new bloc, the respondents would follow due process.

Considering the submissions of learned counsel for the petitioners and learned Stalding Counsel for respondent No.3, writ petition is disposed of with a direction to respondents not to interfere with the possession and enjoyment of the vegetable shops by the petitioners. It is made clear that in case, the respondents undertakes development of market they shall follow due procedure contemplated under law and also rehabilitate the petitioners.
