Heard Sri l.Prabhakar, learned Senior Counsel, appearing on behalf of Ms;.Kanumuri Kalyani, Iearned counsel for the petitioners/appella nts, Sri C.Subba Rao, learned counsel representing Sri Maddy Rajesh, Iearned counsel appearing for respondent Nos l and 2 and Sri Kavali Srinivas, learned counsel appearing for respondent N() 3 and perused the reco'd.
3. The relevant portion of the common order dt 14'10'2020 of the Coutt below reads as under: "The status quo orders referred to above shall be in force pending final disposal of the suit. The suit shall be disposed of as agreed upon between borh the parties within a period of one year from the date of this uncerstating order. It is made clear that the above order is made without prejudice to the rights and contents of both the parties " I I

Though it is contended by the learned Senior Counsel appoaring on behalf of the apo3llants that more than one year has passed by no progress is made in the suit, as many pafties are impleaded as defendants irl the suit subsequently ard as such, the aforesaid suit filed by the i I \ .: ,! 2 respondents/plaintiffs is not likely to be disposed of in the near Future, much less within a year, as noted in the order dt.14.10.2020, which has long passed by and thereby, the status quo order coming in the way of the appellants herein, and having regard to the relationship between the parties to the original proceedings, this court is of the view that instated of this Couft deaiing with the matter on merits, and without expressing any opinion on the merits of the matter, the appellants herein are to be directed to approach the Couft below seeking modification of the order dt.14.10.2020.
5. It is made clear that in the event of the appellants herein approaching the Court below and filing any application seeking modification of the aforesaid order dt.14.10.2020, the Court below shall consider the same in an expeditious manner. 6 Subject to the above observation, the Civil Miscellaneous appeals are disposed of.
