Gp FOR REVENUE The Court made the following: ORDER THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY WRIT PETITION N0.16072 of 2o.25 ORDER: This writ petition is filed seeking following relief: "ForthereasonsstatedintheaccomPanyingaffldavit,thepetitionerhereinpray that the Hon,ble court may be pleased to issue a writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents, particularly the 3.d respondent herein in not conducting sub division survey and demarcation of the land bearing Sy.No.43O/A and SyNo430/U, situated at Hathnoora Village, Hathnoora Mandal, Sangareddy District, on the F-line application of the petitioner dated:O3.O 1.2 O24 & 06.03.2024 is iltegal, arbitrary, unjust and viotation of principtes of natural justice and against the provisions of Survey & Boundaries Act, 1923, and the Rules made thereunder, and consequently direct the respondents 2 & 3 to conduct sub division survey and demarcation and fix boundary stones surrounding land of the petitioner tand bearing Sy.No.430/A admeasuring Ac.O-34 Gts., and Sy.No.43O/U admeasuring Ac.1-O8 Gts., situated at Hathnoora Vitlage, Hathnoora Mandal, Sangareddy District, and to pass such other order or orders as this Honbte Court may deems fit and proper."

It is stated that the petitioner is the pattadar and possessor of land admeasuring to an extent of Acs. 0.34 guntas in Survey No'43O/A and Acs. 1.08 guntas in Survey No.430/U, situated at Hathnoora Village, Hathnoor Mandal, Sdngareddy District (for short, 'the subject land'), having acquired the same from his father by virtue of succession and registered Sale Deed. uide Document No.2734 0f 2014 dated 23.07.2014. It is further stated that the name of the petitioner was reflected in all the revenue records as pattadar and the revenue authorities also issued e-pattadar passbook bearing No.To9o4ol11049 dated 23.03.2019 under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2O2O. It is further stated that due to boundary disputes with the neighbours, the petitioner had 2 cvB&: W.P.No.16O72 of 2O2- submitted F-Line applications dated O3.O1.2O24 and 06.03.2024 to the 3rd respondent, by paying requisite fee to conduct survey of the subject land and hx the boundaries. The grievance of the petitioner is that even after receiving the said F-Line applications, the respondent authorities are not conducting survey and hxation of the boundaries.

3. Considered the submissions of the learned counsel for the petitioner and iearned Assistant Government Pleader for Revenue appearing for the respondents and with their consent, this writ petition is disposed of at the admission stage.

4. l,earned counsel for the petitioner has submitted that in terms of the circulars issued by the Commissioner, Survey, Settlements and Land Records, the respondents are bound to consider the application within 45 days from the date of the application after collecting necessary charges.

Sri L.Ravinder, learned Assistant Government Pleader for Revenue appearing for the respondents has submitted that the respondent authorities will consider the aforesaid F-Line applications submitted by the petitioner by following due procedure laid down under law and conduct survey and demarcate the subject land by fixing boundaries.

It is sett-led law that the Survey Department has the authority to conduct survey and demarcate iands in accordance with the provisions of the Telangana Land Revenue Act, 1317 Fasli (Act No. VIII of 1317 Fasli), the t t ,/ 3 CVBR, J W.P.No.16O72 of 2025 Telangana Survey and Boundaries Act, 1923, and the Rules framed thereunder. The Government has issued various circulars specifying the conditions for conducting surveys, particularly F-Line (field measurement) surveys. Individuals requesting such surveys are required to submit specific documents and if the conditions stipulated in the circulars are fulfilled, the survey and boundary hxation may be conducted. 13.o7.2oo7andRc.No.N2l1741l2o|odatedl8.05.20lostipu1atingthe conditions for conducting survey of private lands and as per the said circulars, if the petitioner fulfils all the conditions of the said circulars, it is an obligation for the respondents to conduct survey within the time specihed in the said circulars' 7 . In view of the aforesaid discussion, this Court deems it appropriate to dispose of this writ petition directing respondent No.3 to consider examine the petitioner's F-Line apptications uide Transaction ID Nos.TTDERo224o|oo3573 dated o3.01'2024 and, TTDER02240|025676 dated o6.o3.2024, in accordance with the provisions of the Telangana Survey and Boundaries Act, 1923 and also in terms of the circular instructions issued by the Commissioner, Survey, Settlements and Land Records for conducting survey on field measurement applications B 4 W.P.No.16072 CVBRI (F-Line applications) from time to time, within a period of four (O4) weeks from the date of receipt of a copy of this order, if not already conducted.
