4. karned Standing Counsel for respondent No.3 would submit that previously the Municipality has contemplated a development plal with an intention to construct new blocks and requested the petitioner to vacate the premises temporarily with an assurance that shops will be allotted to the petitioners in the newly constructed block. He would further submit that proposed development plan has been put on hold and thus, apprehensions of the petitioners are misconceived and therefore, the writ petition is liable to be dismissed. He would further submit that in case if respondents intend to proceed with the construction of new block, the respondents would follow due process.
5. Considering the submissions of learned counsel for the petitioners and learned Standing Counsel for respondent No.3, writ petition is disposed of with a direction to respondents not to interfere with the possession and enjoyment of the vegetable shops by the petitioners. It is made clear that in case, the respondents undertakes development and construction of new block, they shall follow due procedure contemplated under law and rehabilitate the petitioners. There shall be no order as to costs. Miscellaneous petitions, if any pending, shall stand dismissed.
