Counsel for the Petitioner: SRI PRABHAKAR CHIKKUDU Counsel for the Respondents: AGP FOR REVENUE The Court made the following: ORDER THE HON'B LE sRI JT'STICE C.V.BHASKAR REDDY WRIT PETITION No.15598 of2o.25 ORDER: This writ petition is filed seeking following relief: "For the reasons stated in Affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ order or direction, more particularly one in the nature of writ of mandamus declaring the action of the Respondents in showing the Petitioner's Agricultural Land in the Revenue Records blocked for transaction vide Bhu Bharathi Docu-ert uploaded in the Electronic web to an extent of Ac 1-02 Gts situated in sy.No.1gg/A/1 of Akulavari Ganapuram Village' Mandal Eturunagaram' Mulugu District as an ex-facte, illegal' arbitrary' discriminatory' unjust' unfair' unreasonable' unlau,.ful, irrational, unconstitutional and against the Guidelines prescribed in the scheme of Bhu Bharathi and in violation of the Principles of Natural Justice and in violation of Article 14, 2t & 300-,{ of the Constitution of India and against to the Catena ofJudgments of an Apex Court and this Hon'ble Court and set aside the same and consequently, direct the Respondents to delete the biocked list in transaction of the Agricultural land of the petitioner to an extent of Ac-t-02 Gts situated in Sy.No lgglAll of Akulavari Ganapuram Village' Mandal Eturunagaram' Mutugu District and pass such other order or orders as this Hon'ble Court may deem fit proper and the circumstances of the case'

It is stated that petitioner is the absolute owner and possessor of agricultural land admeasuring Acs. 1'02 guntas in Survey No.188/A/ 1, situated at Akulavari Ganapuram Viilage, Eturunagaram Mandal, Mulugu District (for short, 'the subject land'), having acquired the same from his father and the petitioner's name is mutated in all the revenue records and e- pattadar passbook was also issued in his favour under the provisions of the Telangana Rights in Land ard Pattadar Passbooks Act, 2O2O (for short, 'the Act 9 of 2O2O). ltis further stated that the petitioner noticed in Bhu Bharati Web portal that the nature of the subject land has been shown as "This survey no. is blocked 16p transaction" without issuing "y_ryti.. or without .- 2 CVBR, J W.P.No.15598 of 2025 - assigning any valid reasons and therefore, he made a representation dated
17.04.2025 to the 3'd respondent to delete the said endorsement. The grievance of the petitioner is that even after receipt of the said representation, the respondent authorities did not r;onsider the same. Hence, the present writ petition.
3. Considered the submissions made by the learned counsel for the parties and with their consent, this writ petition is disposed of at the admission stage. 4 . Learned counsel for the petitioner has vehemently contended that recording of entries in Bhu Bharati Portal is only a consequential act of carrying the entries which have already been made under the provisions of the Act 9 of 2O2O. Learned counsel further submitted that the entries made in the pattadar passbook are only compilation of the survey numbers and the accounts for the extent being mentioned in a particular village and therefore, it does not take away the right of the petitrcner in any manner unless the entries in the revenue records are correcte d by following due procedure.

Sub-section (4) of Section 22-A of the Registration Act, 19O8 confers the power on the State Government either suo motu or on an application by any person or for giving effect to the finat orders of the High Court of Telangana or Supreme Court of India to proceecl to de-notify, either in full or in part, the notification issued under sub-section (2) and rules CVBR, J W.P.No.15598 of 2025 made under the provisions of the Act. Further, as per the standing order 2lg (bl of the Registration Manual Part-II, the revenue authorities are not having any right or authority to list any private patta lands in the prohibited list that too without conducting any enquiry'
6.ThisCourthascarefullyexaminedtheinformationfurnishedto the petitioner under Bhu Bharati web Portal wherein except stating in the Transaction Status that "This survey no. is blocked for transaction", no reason has been assigned. Therefore, the action of the respondent authorities blocking the subject land of the petitioner without conducting anyenquiryandwithoutaffordinganopportunitytothepetitioneramounts to violation of principles of natural justice and also violation of Articles 14, 21 and 300-A of the Constitution of India.

Learned Assistant Government Pleader for Revenue appeanng for the respondents submits that the petitioner has not made any appiication for deletion of the subject land from the block list or de-link the { I subject land from the block list and if the petitioner submits an appropriate application for deletion of the subject land from the block list, the respondent authorities will consider the same strictly in accordance with the Registration Act, 1908.

In view of the above submission, this Court deems it appropriate to dispose of the writ petition directing the petitioner to submit an appropriate application for deletion of the subject land from the block list. CVBR, J W.P.No.15598 oJ 2O25 - In the event of such application being made by the petiti.ner, the respondent 4 authorities shall examine the said application strictly in accordance with the provisions of the Registration Act, 19o8 and taking into consideration of the pattadar passbook issued earlier under the provisions of Act 9 of 2o2o and pass appropriate orders in accordance with iaw. Further, in any event, if the petitioner is not entitled for deletion of the status of the land in Bhu Bharati web Portal, the respondent authorities are directed to pass a reasoned order and communicate the same to the petitioner. The entire exercise shall be completed within three (03) months from the date of receipt of a copy of this order. 9 With the above observations, the Writ petition is disposed of.
