3. The case of the petitioners is that th e farht,r of the petitioners war; the absolute owner of the land ,a<lrrreasuring Acs.4-22 guntas in Survey No.451, situated at l.hangel agudem, H/o. Cheedella of penpahad Maldal, Suryapet Dist rict, (for short 'ancestra l propertyJ, and land guntas and Ar.O-lZ guntas in 451 /E/5 respt:,:tively situated Survey Nos.4,5 l/lI7 ard at Thangellagud,_-nr, H/o. Cheedella of Ft:npahad Mandal, (for short ,self rrcquired property) was purchased by petitioner No.l uid.e, reqistered document bearir5J No.r694 of 2oro dated 19.o2.,.)o7r) ard 196 I of 2010 dated 26.02.2010 respectively. The father of the petitioners ra,as i ssued pattadar passbook and title cteed in respect of their ancestral property. After the deatr of LLis father, petitioners d ir.idr:rl th e ancestral property arnorlg th er rselves and got mutated rheir names in the revenue records ar d they were also issr_Led pattadar passbooks. 3 iIBKJ W.P. No.15404 of 2o2s It is submitted that when respondent No'5 tried to 4. interfere with the ancestral property of the petitioners' the father of petitioners filed a suit in O'S' No'210 of 2Ol2 on the hle of learned Principal Junior civil Judge' Suryapet', (for short "Trial Court') which was decreed on O8'09'2022' Aggrieved by the same, respondent No'5 preferred an appeal in A'S' No'48 of 2022 before the learned Principal District Judge' Suryapet' for setting aside the judgment and decree dated O8'09' 2022 passed by the Trial Court in O'S' No'210 of 201'2' and the same is pending for consideration' It is submitted that respondent No'5 is claiming Acs'2-OO 5. guntas in Survey No'451 of Thangellagudem' H/o' Cheedella of Penpahad. Mandal' As his mutation application was rejected' he filed W.P. No'244 45 of 2024' which was disposed of by this Court by the order d'ated' O4'09'2024' Pursuant to the said order, respondent No'4 issued impugned notice No.B/ 159/20 24 dated' 27 'O5'2O25 calling upon the petitioners to submit documents to support their claim over the subject property. 4 NBK,' w.P. 6. The gr evance of the petitioners is that responrient No.S is trying to disllrssess the petitioners from the sub-tect property on the guise of ;mpugned notice issued by responde nt No.4 uide No.B/ 159/2{)24 dated 27.O5.2O25. Hence, the p.esent Writ Petition.
