2. Against the order dated 03.04.2019 passed 1n O.P.No.61 of 2Ol1 by the Senior Civil Jurl3e, Gadwal, LAAS No.l13 of 2019 is filed by the Lanrl Acquisition Officer-cum-Special Deputy Collector and Ll" rS No.85 of

20.19 and Cross Objection No.59 of 2O2I arr filed by the claimants

Learned counsel appearing for the appel.lants- claimants (LAAS No.85 ot2Olgl had contende r that lands of the appellants-claimants situated at Atmz kur Village were acquired for the purpose of excavation r nd forming embankment of parallel canal to Priyadarr; rini Jurala Project and the subject lands are fertile lands : nd they are 2 situated half kilometer from Atmakur Bus Stand. Learned counsel had further contended that without conducting proper enquiry and without following the mandatory provisions laid down under Sections 15 and 23 of the Land Acquisition Act, 1894 (for short the Act'), the Land Acquisition Ofhcer has determined the lowest market

4. Learned counsel appearing for the appellants- claimants had further contended that O.P.No.61 of 2011 was disposed of along with O.P.Nos.64 of 2017 & 52 of 2012, uide common order dated 03.04.2019. Aggrieved by the order passed in O.P.No.64 of 2Oll, the Land Acquisition Ofhcer has filed LAAS No. I32 of 2019 and the claimants therein hled X-Objection No.64 of 2021 and this Cotrt uide common judgment dated 25.04.2025 dismissed the appeal hled by the Land Acquisition Officer and allowed the Cross Objections hled by the claimants by enhancing the market value of the land acquired therein to Rs.700/- per square yard with all statutory benefits as ) stipulated in the amended Land Acquisrl.on Act, by following the judgment dated 28.O9.2022 rerL lered by this Court in LAAS Nos.599 of 2Ol7 and 50 of 2Ol\ , w'hich was conhrmed by the Apex Court and therefore, ;imilar order be passed in these matters also.

Learned Government Pleader appear ng for the appeilant-Land Acquisition Officer (LAAS No l3 of 2019) had contended that the lands covr red under L.A.A.S.Nos 599 of 2Ol7 and 50 of 2O2l arr situated at Atmakur Village, whereas, the lands in que r tion are far away from Atmakur village. Therefore, the : rrlier order, dated 28.09.2022 passed by this Court in L.l. A.S.Nos.599 of 2017 and 5O of 2021 has no application t,t the present cases. Learned Government Pleader had furtht r contended that the Reference Court has deducted : O% of the compensation awarded for the lands co u :red under L.A.A.S.Nos.599 of 2Ol7 and 50 of 2021. Sinct the subject lands are situated far away from Atmakur Village, the 4 Reference Court ought to have deducted 60%o of the compensation.

Learned Government Pleader had further contended that L.A.A.S.Nos.599 of 2Ol7 and 5b of 2021 are hled aggrieved by the order dated 13.O4.2017 passed in O.P.No.7 of 2011, wherein, the Reference Court has awarded compensation on square yard basis, but not on acerage basis. But, in the instant case, the Reference Court has awarded the compensation on acerage basis' Therefore, there is a clear distinction between the order, dated 13.04.2017 passed in O.P.No-7 of 2Ol1 and the order passed in O.P.No.6l of 2011. Therefore, the appeal frled by the Land Acquisition Officer deserves to be allowed and the appeal and the cross objections preferred by the claimants are liable to be dismissed-

Having considered the rival submissions made by both the parties and on perusal of paragraph No'20 of the Reference Court order, it is to be seen that the Special Deputy Collector has admitted in his cross-examination I \ 5 that the lands in question are situated half li.ometer away from Atmakur bus stand. Therefore, the cor: I ention of the learned Government pleader that the lands in question are situated 4Yz klTometers away from Atrnakur r, Lllage cannot be accepted. Therefore, this Court has right.. followed its earlier order and dismissed the appeals pre I :rred by the State and allowed the cross objections pre [ .rred by the claimants as indicated above. Hence, this Co rrt is bound to follow its earlier orders ancl the present aplt :al preferred by the State is liable to be dismissed and thr appeal and cross objection preferred by the claimants cl rserve to be allowed.

8. Accordingly, L.A.A.S.No.1 l3 of 2019 is di ;missed and LAAS No.85 of 2Ol9 and Cross Objection No.5l of 2O2l in L.A.A.S.No.113 of 2OL9 are allowed. The c..r.imants are entitled to the market value of the acquired I Lnds on the enhanced rate of Rs.7O0/- per square yzL: d. with all consequential benefits under the amer ded Land Acquisition Act. However, it is made clear thzL appellants \ I Li ? i l l 6 in LAAS No.B5 of 2OI9 and the Cross Objectors shall pay deficit Court fee, if any, on the enhanced compensation.
