MOHIT'DDIN OF AND 1 7 COMMON ORDER: Since the issues that arise in the above writ petitions are integrally one and the same, the writ petitions are being disposed of by this Common Order. 2- Heard Sri G.Vidya sagar, learned Senior counsel representing Sri s.K.s.Kiran, learned counsel for the petitioners, Sri s.Rahul Reddy, learned Special Government pleader attached to the office of the learned Additional Advocate General appearing for the State, Sri N.Avaneesh, learned standing counsel for National council for Teacher Education and sri N.Bhujanga Rao, learned Deputy Solicitor General of India and perused the record.

The above writ petitions are filed under Article 226 of tt,e constitution of India, challenging the recruitment process for special Education Teachers as notified by the Government of Telangana uide G.o.Ms.No.4, school Education (Ser.III) Department of the Government of Telangana, dated 2g.o2.2024, 2 and the consequent Notification No.24/RC-1/TRT/DSC 12024, dated 2g.o2.2o24, with the following identical prayet vIZ., ...this Hon'ble Court mag be pleased to issue a utrit, order or direction more particulartg one in the nature of Writ of Mandanlus or ang other appropiate writ to d.eclare the G.O' Ms' No' 4, School Education (Ser.tII) Department, dated 28-2-2024 in so far as prescribing 2oo/o score for tlrc Teacher Eligibititg Test under Rule-3 a.s iuegal and" ctrbitrary; prescription of the pass rn Paper-l of Telangana state Etigibitity Test (TSTET)/ Andlva Pradesh Teacher Eligibility Test (APTIIT)/ Centrat Teacher Eligibititg Test (CTET) or Paper II of Telangana state Etigibilitg Test (TSTED as illegal, arbitrary and uiolatiue of Article 14 & 16 of Constitution of India and uiolatiue of nornls prescribed by the Rehq.bilitation council of India (RCI); and Consequently, direct the Respondents to conduct the recruitment to the post of speciat Educatiort Teachers in the cadre of secondary Grade Teachers and, school Assisfanfs bg considering the norms framed bg Rehabilitation cout'-cil of India (RCI) uithout insisting on the qualifi<:ation of pass in Paper-l/ Paper-II of Teacher Eligibilitg Test and. prescibing the 2oo/o score as method of recruitment to the post; and. pass such other ord.er or orders as this Hon'ble court mag deem fit and proper in the iterest of justice. Brief facts of the case:

The present dispute arises from the State's decision to initiate recruitment of Special Education Teachers to facilitate inclusive education in Government and Local Body Schools' Pursuant thereto, the Finance Department, uide G.O.Ms.No.97 dated 26.08.2023, accorded sanction for 796 posts of Special Education Teachers at the Primary Level (Secondary Grade Teacher - SGT) and,727 posts at the Upper Primary/Secondary Level (School Assistant - SA). Subsequently, the sanctioned strength was modified uide G.O.Ms.No.26 dated 26.02.2024, whereby the posts were authorized as 796 for SGT (Special a 1 .) Education) and 22O for SA (Special Education), aggregating to 1,O16 vacancies.

Further, in order to govern this recruitment, the State promulgated "The Telangana Direct Recruitment for the posts of Special Education Teacher at Primary level in the category of Secondary Grade Teacher and Special Education Teacher posts at Upper Primary/Secondary Level in the category of School Assistant in Government & Local Bcdy Management Schools in the State (Scheme of Selection) Rules, 2024" uide the impugned G.O.Ms.No.4, dated 28.O2.2024 (for short "the impugned Rules"). Based on these rules, the Commissioner of School Education issued the recruitment Notilication No.2a/RC-1/ TRT/ DSC I 2024, dated 29 .O2.2O24.

The petitioners, who possess qualilications in Special Education (D.Ed./B.Ed. in Special Education) from institutions recognized by the Rehabilitation Council of India (for short 'RCI) have challenged the impugned Rules and Notilication on several grounds, wherein their primary grievances are: l. In respect of Rule 3 and a(iif(af & {bl of the Rules 2ol242 These rules mandate passing the general Teacher Eligibility Test (for short I|ETJ and assignment a 2Ooh weightage to the TET score in the frnal selection process. The petitioners contend that the condition is arbitrary as the general TET is not tailored to assess the corlpetencies of a Special Education Teacher. \ 4 ii. Violation of RCI Norms: The petitioners argue that. the said recruitment process violates the norms prescribed by the RCI' which were accepted by the Ministry of Education, Government of India, and which the Hon'ble Supreme court of India, in its order dated 21.07.2022 in Raineesh Kuttdr Pandeg & ors. as. tlnion of India & ors.r, expressly directed all States to comply with. '

This Court, uid"e interim order dated L8.O6.2O24 in the present writ ltetitions, permitted the petitioners to participate provisionally in the selection process with the direction that their results be kept in a sealed cover subject to the final outcome of these writ petitions. The respondents have filed their counter-affidavits seeking dismissal of the writ petition'
8. The iearned Senior Counsel for the petitioners has vehemently contended that: i. The said recruitment process is ultra uires to the Rehabilitation council of india Act, 1992 {for short 'RCI Act, 1992J. It is contended that the RCI is the sole statutory authority for regulating "Rehabilitation Professionals," which includes Special Teachers, and its norms, especialiy after being endorsed by the Apex court in Ro;ineesh Kumar Pandeg (Supra 7), are binding on the State. ii. The said recruitment procedure prescribed by the RCI, as conveyed by the Mini:itry of Education through its ' w.e.lcivit; No.l32 of 2016 ) communication dated LO.O6.2O22, mandates selection through CTET/TET/NTA Score + Demonstration of Classroom teaching + Interview or as per the recruitment process adapted from time to time. It is contended that the state has arbitrarily ignored the latter part of this process (demonstration and interview) and has misinterpreted the frrst part. iii. The term "TET" as stated in the RCI norms ought to be construed as a "Special TET," grven that the context pertains to the recruitment of Special Educators. The impugned practice of subjecting candidates possessing specialized qualifications to a general test intended for general category teachers is violative of Article 14 of the Constitution of India. Further, the neighbouring State of Andhra Pradesh has correctly interpreted the RCI norms by conducting a separate "Special TET-cum- TRT" for Special Educators, which serves as a persuasive precedent. iv. Assigning a weightage of 2Oo/o to the general TET score is irrational and arbitrar5r, and causes.prejudice to meritorious candidates possessing specialized qualifications in Special Education, who may not necessarily perform optimally in a generalist examination. Contentions of the respondents:.
9. The learned Additional Advocate General, appearing for the State/respondents, contended that: i. The impugned Rules are in consona.nce with the norms prescribed by the RCI as well as the directions issued by the \ 6 Honble Supreme Cot:rt. The guidelines issued by the RCI unequivocally stipulate "CTET/TET/NTA Score" as the initial stage in the recruitment process, without affrxing the prefix "Special" to TET. Thus, the petitioners'attempt to import such a qualil'rcation into the guidelines is unwarranted and without basis. The decision to recognize and rely upon the existing statutorily sanctioned TSTET/CTET constitutes a valid and reasonable constmction of the RCI guidelines. Therefore, to direct the State to devise and conduct a separate "Special l'ET" would amount to judicial overreach into matters of policy, which is impermissible.
111. The phrase "...or a.s per the recruitment process udapted from time to time" contained in the RCI guidelines grants the State requisite flexibility to modify the recruitment process. In this regard, the State of Telangana, pursuant to a deliberate policy decision embodied in G.O.Ms.No.47 dated L1.O4.2O22, has dispensed with the interview component for most direct recruitments to promote transparency and objectivity, which is a valid and tenable adaptation. The posts in question pertain to Special Education Teachers appointed to serve in general schools to facilitate inclusive education rather than exclusively in special schools. Consequently, it is reasonable and justiliable to require such teachers to satisfy the minimum eligibility criteria i.e., TET applicable to all teachers within the general education system, 7 n alongside their speciaJized qualifrcations assessed through the main written examination i.e., TRT. v The recruitment practices adopted by other States do not bind the State of Telangana, as it is entitled to formulate its own recruitment policy in consonance with the national framework. The allocation of 2Oo/o weightage to TET scores as part of the selection process is a consistent and rational policy applied across teacher recruitments in the State and does not suffer from any infirmity. Furthermore, the learned Standing Counsel for Respondent No. 6 (NCTE), in ttre counter-affidavit, has clarified that the NCTE does not exercise regulatory jurisdiction over Special Education, which falls exclusively within the domain of Respondent No. 7 (RCI).
10. We have taken note o[ the respective contentions urged.

The core issue for determination in the present case is whether the impugned Rules (G.O.Ms.No.4) and the consequent recruitment notification are arbitraly, iilegal or violative of the RCI norms as endorsed by the Hon'ble Apex Court in the case of Rajneesh Kumar Pandeg (supra 1). Consideration Court: The issue of interpretation of RCI norms and the Requirement of TET: \ 8
12. It is the case of the petitioners that the state has violated the RCI norms. The relevant portion of the RCI guidelines, as circulated by the Ministry of Education and noted by the Hon'ble Supreme court, prescribes the "Recruitment process" .as: "Through CTET/TET/ NTA Score + Demonstration of Classroom teaching + Interuiew or as per the recruitment process adapted. from time to time." It is pertinent to note that a plain reacling of the aforesaid clause makes it rrnequivocally clear that a score in CrET/TET/NTA is a mandatory eligibiliry criterion. The petitioners' <:ontention that there should be a "special rET" is an interpretation, that finds no support in the plain language of the text. The language used is generic. The term "TET," being of generic import and possessing a settled meaning in the context of the Right of children to Free and compulsory Education Act, 2oo9 (for short 'RTE Act 2oo9J, and the NCTE guidelines, does not necessitate any addition such as "Special" by this court. Thus, the state Government's action of insisting on a pass in the existing TSTET/crET is, therefore, a direct implementation of the RCI gtridelines. The issue of flexibility in recruitment process: 13. It is to be noted that the RCI guidelines itself provide flexibility to the recruiting agency by adding the phrzrs e, ,,...or as I 9 per the recruitment process adapted fram time to time-"- The said provision permits the States to tailor the recruitment process in accordance with its requirements. [n exercise of this delegated power, the Government of Telangana, uide G.O.Ms.No.47, has dispensed with the requirement of interviews in direct recruitments as part of its policy to enhance transparency, which constitutes a legitimate and lawful adaptation of the process. Therefore, the petitioners cannot compel the inclusion of classroom demonstration and interview stages when the governing framework itself expressiy allows the State the requisite flexibility to modify the procedure. The issue of Discrimination under Article 14 of the Constitution of India:

The petitioners' contention that mandating them to appear for a general TET infringes Article L4 of the Constitution is without merit, as for the purpose of establishing a foundational eligibility criterion to teach in State-run general schools, all candidates whether fcrr general or special teaching posts constitute a permissible single class. However, the requisite differentiation on account of their specialized skills is effectuated by: a) the specific educational qualifications mandated, namely D.Ed./B.Ed. in Special Education, and l0 b) the syllabus of the main written examination (TRT), which allocates significant emphasis on assessing proficiency in special education.

It is to be noted that the selection process when considered in its entirety does not result in treating unequals as equals; however, it prescribes a common minimum eligibility threshold prior to the assessment of specialized competencies. The issue of weightage for TET Score and the precedent of Andhra Pradesh:

It is pertinent to note that the impugned policy of according 2oo/o weightage to TET scores in teacher recruitment is a measure to accord due recognition to the eligibility test, reflecting a well-established academic and administrative practice. This Court is of the view that such weightage, being a facet of educational and recmitment policy, does not appear to be manifestly arbitrary or irrational, particularly as it is uniformly applied to all candidates without discrimination.

Further, the conduct of a "Special TET" by the State of Andhra Pradesh constitutes a policy decision peculiar to that state and it does not give rise to any legally enforceable right in favour of the petitioners in the state of Telangana. This court reiterates that each State possesses the autonomy to frame its own procedural mechanisms for recruitment, provided they \ remaln rn consonance with the overarching framework laid down by the RCI. Inasmuch as the impugned Rures have been found to be within the statutory and reguratory framework prescribed by the RCI, the mere existe,ce of a differing practice in a neighbouring State cannot serve as a basis to invalidate the Rules in question.

[n the light of the aforesaid discussion, we find no merit in the contentions raised by the petitioners, as the impugned G.o.Ms.No.4, dated 28.02.2024, is not in violation of the norms prescribed by the RCI or the directions of the Hon'ble Supreme court. Further, the requirement of passing the general TET and the weightage assigned thereto is a matter of poricy that is neither arbitrary nor discriminatory. Thus, the State has acted within the flexible framework provided by the RCI guidelines and thereby, the writ petitions fail.
19. Accordingly, the writ petitions are dismissed. The interim orders dated L8.o6.2o24 granted by this court in the present writ petitions stand vacated and I.A.Nos.4 of 2024, 2 of 2024 and 2 of 2024 in the respective writ petitions are disposed of. The respondents are directed to proceed with the recruitment process, ftnalize the selection and declare the results of all candidates including the petitioners whose results were kept in t2 a sealed cover in accordance with the impugned Rules and Notification.
