The : t::,.: r f the petitioners, in br-:ef, is that, r.nOrrtir they had approacheo icriFrc i dent Nos.12 to 15 and lodgecl a _orr rlaint on 26.04.2025 t(r -(lc j,l.er an FIR based on lne contents cf .he, (.orirl)aint and to have a fatr irr,/rl.ti!ation into lhe mai.ter in accordancc wirl lauv, no /reQistr.trr:,J whicit action cf rhe respondent:;-a itt no r i ies jt is 1; i I i I 2 contended as htghly lllegal, arbitrary, in violatron of Articles 14 and 21 of the Constitution of India and also the guidelines laid down by the Apex Court in Lalita Kumari v/s. Government of ll.P.l, with a consequential direction to the respondents to forthwith register a crime based on the complaint submitted by the petitioners.

Per contra, learned Government Pleader for Home appearing on behalf of respondent Nos.1 and 12 to 15 would submit that, though the petitioners had approached the respondents-a uthorities and lodged a cornplaint on 26.04.2025 claiming act of forgery and executing sale deeds despite restraint orders from this Court, the authorities have taken up preliminary enquiry and if the enquiry reveals commission of any cognizable offence, the authorities would register a crime and investigate thereinto

Learned Government Pleader further submits that, after causing preliminary enquiry, in the event the authorities come to a conclusion of the dispute to be civil in nature, they would take further action thereon by informing to the petitioners, in such an event, the petitioners have to avail further remedies provided under BNSS.

Since, it is stated that the compiaint given by the petitioners to respondent No' 15 is under investigation, this court is of the view thai the are directed to conduct preliminary enquiry and inform the petitioners of ihe action taken either by registering FIR or issuing an intimation of the action taken to enabre the petitioners to avail further remedies under BNSS.

10. Granting liberty as noted above, the Writ petition is disposed of. No order as to costs.
