The petitioner has filed the inslant writ petition being aggrieved by the action on the part of respondent Nos'2 and 3, who are developing a portion of the land for the National Highways Authority and also constructing a toll plaza on the said land, which situates in front ofthe property of the petitioners'

3. Leamed counsel for the petitioners submits that the respondents now in the process have entered into or encroached I I upon the private property owned by the petitioners and which has not been acquired for the said purpose nor was it notified in the notification dated 1 5. 10.201 I' i \

Lee.rned Standing Counsel for the NHAI, on the cc,ntrary, submits that vrhatever construction that is being rraised is strictly on the land u hich has been acquired and which srand:; rrotified vide notihcation dated 15.10.2011 and that respondent Nos.2 and 3 have not deviated even the slightest part [rom the hotificaticn datcd 15. 10.201 1.

5. Given t-re fact that respondent Nos.2 and -l have rnade a categorica I stz tcment that they have not deviated or mar-le any constructirrn beyond the land which has been acquired by the notification dan:d I 5. 1 0.201 1, this Court sees no reason tr.r keep the present writ petition pending.
