Mulugu, Siddipet Commissionerate. i I I i I I // This Petrtion coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri Chekka Rajkumar, Advocate for the Petitioner and Sri V.Jithender Rao, Additional Public Prosecutor on behalf of the Respondent state. / The Court made the following: ORDER / THE HON'BLE SRI JUSTICE NARSING RAO NANDIKONDA / Criminal Petition No.6604 of 2025 Order: This Criminal Petition is filed by the petitioner/accused No.6 under Section 482 of Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS) seeking to quash the proceedings in Crime No.83 o12025 on the file of Mulugu Police Station, Siddipet Commissionerate, registered for the olFences punishable under Sections 8(c) read with Section 20(bxiiXA) and 27(b) of NDPS Act.
Heard leamed cotursel for the petitioner and Sri V. Jithender Rao, leamed Assistant Public Prosecutor appearing for the respondent/State
During the course of hearing, it is brought to the notice of this Court that the offences levelled against the petitioner are punishable with an imprisonment of less than seven years.
In view of the same, without going into the merits of the casc. this Court deems it appropriate to direct the Investigating Olficer to scrupulously follow the procedure contemplated under Section 4 I -A of the Criminal Procedure Code, 1973 (Cr.P.C.)/Section 35(3) of BNSS and thc guidelincs issued by the Hon'ble Apex Court in Arnesh Kumar Vs State 2 of Biharr. On such notice being given, the petitioner/accused No.6 shatl appear before the concemed Investigating Officer as and when directed The concerned Investigating Officer is directed to permit the petitioner/accused No.6 to take assistance of the lawyer during the course of investigation.
It is made clear that the petitioner/accused No.6 shall cooperate with the Investigating Officer for the investigation and make himself available to him as and when required and also provide the information/documents as sought by him to conclude the investigation.
If the petitioner/accused No.6 fails to cooperate with the Investigating Olficer for investigation, the Investigating Officer is at tiberry to take action against him in accordance with law.
