3. With the consent of the learned counsel for the parties, the writ petition ls disposed of at the stage of admission.
4. Brief facts of the case:
4.\. The petitioners averred that they are the owners and possessors of the agricultural lands covered by various survey numbers situated at Eturunagaram Village and Mandal of Mulugu District. The petitioners submitted an application on 05.01 .2021 befote respondent No.2 seeking grant of pertnission for de-casting sand from their patta lands so as to make them fit for agricultural activities. The District Coilector, Mulugu, issued proceedings dated
25.O3.2023 by imposing severa-l conditions for de-casting ol sand from therr patta 1ands. However, the same was not considered. Thereafter, the petitioners approached this Court by filing W.P.No. 1i377 of 2025, nhich was disposed of on24.O4.2O25 directing the Forest Range Officer, Eturunagaram South Range, Mulugu District, to consider the explanation submitted by the petitioners dated 10.03.2025. Horvever, the Forest Range Ofhcer has not stated any objection for de-casting the sand from the patta lands of the petitioners. In the meantime, the period for de-casting the sand has expired on
13.03.2025. At that stage, the petitioners submitted a representation before the District Collector and also respondent Nos.2 and 5 on 30.04.2025 requesting them to extend the lease period of the agreement dated 13.O3.2024 pursuant to the order dated 24.04.2025 passed by this Court in W.P.No.11377 of 2025. However, the respondents have not taken any action on the said representation. 7. Having considered the rival submissions made by the respective parties and on a perusal of the material available on record, it reveals that respondent No.3 had entered into an agreement with the petitioners
13.03.2024 for de-casting 1,13,318 cubic meters of sand from the patta lands of the petitioners. It is not in dispute that out of thc said quantity, only 46.,769 cubic meters of sand was de-casted and the remaining quantity of 66,145 cubic meters of sand is not removed. It is also not in dispute that respondent No.2 issued proceedings on
09.O1.2025 permitting the petitioners to de-cast 66,145 cubic meters of sand from O9.01.2025 to 13.O3.2025. in the meanwhile, the Forest Range Officer, Eturunagaram South Range, stopped the de-casting of sand through notice dated 05.03.2025. The petitioners submitted the representation on 10.03.2025 and have also filed W.P.No.ll377 of 2O25 when the said representation was \ \ w / -l: i{.*;*-r+€i+Aotconsider-t:rl.
