Judgment
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to issue a Writ of Mandamus directing the respondents to discontinue the rowdy sheet, pending against the petitioner, on the file of third respondent and consequently direct the respondents not to harass the petitioner.
The brief facts that are necessary for the disposal of the present writ petition may be stated as follows : A rowdy sheet is opened against the petitioner, who is a student, when he was involved for the offence punishable under Section 354 of I.P.C. The Police after completion of investigation filed charge sheet, which was taken on file as S.C. No.442 of 2009, on the file of Assistant Sessions Judge, Pittapuram, East Godavari District, and the same was ended in compromise before the Lok Adalat on
31.12.2010 vide Award in case No.336 of 2010. However, the third respondent is still continuing the rowdy sheet against the petitioner, even though the matter was settled before the Lok Adalat on
31.12.2010.
Heard both sides.
Admittedly, the second respondent herein is the competent person to take appropriate decision in accordance with Standing Order 601 of A.P. Police Standing Orders for closure of the rowdy sheet.
Operative part
Therefore, the writ petition is disposed of directing the petitioner to make an application to the second respondent seeking to close the rowdy sheet pending against him and thereafter the second respondent shall consider the same, in accordance with law, particularly with reference to the Standing Order 601 of A.P.
