RAM srNGH, Advocate for the Respondent No. 2 The Court made the following COMMON ORDER THE HONOURABLE SRI JUSTICE N.TUKARAMJI l.A.Nos. 3 AND 4 OF 2025 ln/And CRIMINAL PETITION No.6473 OF 2025 COMMON ORDER This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (tor short lhe BNSS'), seeking quashment of the proceedings against the petitioner in Crime No. 108 of 2025 of Osmania University City Police Station, Hyderabad.
2. The petitioner is the sole accused in the Crime registered for the offences punishable under Section 69 o,f Bharatiya Nyaya Sanhita, 2023 (for short 'the BNS'), Section 3(2)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 2015.
3. Heard Mr. Rajendra Prasad D and Mr.Y. Naveen, learned counsel for the petitioner, Mr.Jithender Rao Veeramalla, learned Additional public Prosecutor, representing respondent No.1-State and Mr. L.Ram Singh, learned counsel for respondent No.2/de facfo complainant.
4. Pending this petition, the parties have entered into the compromise and, accordingly, they moved l.A.Nos.3 and 4 ot 2025 with the prayer to permit them to enter into compromise and by recording the setflement to quash the proceedings against the petitioner/accused in Crime No. 108 of

5. This Court vide o'der dated 09.06.2025 referred the parties to the High Court Legal Services Committee for identification and to verify the voluntariness in arriving the settlement. The Secretary High Court Legal Services Committee, has submitted report dated 16.06.2025 stating that the parties were identified by their respective counsel and also on verification of Aadhar Cards/ldentity Cards and the e:nquiries revealed that the parties have willfully and without coercion entered into settlemenUcompromise
6. I have considered the submissions of lhe learned counsel and perused the materials on record

The accusations against the petitioner/accused rn the Police Report lodged by respondent No.2/de facto complainart arc that the petitioner/accused induced her on the pretext of marr age and sexually exploited her. Having considered the ailegations anrj the subsequent developments of marriage of the petitioner with the de facto complainant and the statement in the Affidavit of responderft No.2lde facto complainant that the petitioner and herself got married ernd living together and the amicable settlement between the parties and to restore peace among them, in the light of the Cictums in Gian Singh v. State of Punjab 3 NT1(,Jr I-4Not. ) and 4 oJ 202 i in/ a Crl.PNo. 617 ) ol 2025 and anothert and Anil Mishra y. Sfate of ll.p.z; Sfate of Madhya Pradesh v. Laxmi Narayan and others3, this court is of the considered view that quashment of the impugned proceedings in view of the settlement by exercising jurisdiction under section 4g2 cr.p.c.ls2g ot BNSS, 2023, would be in the interest of justice.
8. Accordingly, l.A.Nos. 3 and 4 of 2025 are allowed. Consequently, all proceedings in crime No. 10g of 2025 of osmania University city Police Station, Hyderabad, are hereby quashed against the petitioner/accused.
