It is iurther stated that thereafter with a view to maintain the said plots cf land, the petitioners along with other similarly situated persons formed into a registered society on 24.72.2OOg, which in turn executed Notarised Gift Deeds and sale deeCs in their favour by allotting 80 square yards each and thus they are in possession of the said plots, by constructing single room houses thereon. The grievance of the petitioners is that despite the same, the respondent authorities are trying to demolish the structures/houses on the subject plots, without issuing them any notice or opportunity and without following the due procedure as contemplated under law. I 4 :l and there are no constructions/ structures whatsoever on the subject land Learned Government pleader for Revenue appearing for respondent Nos. 1 to 4 submits that the land- claimed by the petitioners is forming part of Survey No.3Og, whereas the land glaimed by respondent No.5 is forming part of Survey Nos.3O7 and 308; thus, there are serious disputes with regard to right, title, possession and naturc/classification of the subject land, which are required to be adjudicated by the crv court in a properly instituted in civii suit; and as such the present writ petition as filed by the petitioners is not maintainable. In view of the above and since it is evident that there are serious disputes among the parties with regard to flght, title, possession and nature/classihcation of the land, which are required to be adjudicated by the competent civ court, this Court, without expresstng any opinion on lhe merits of the matter, deems it appropriate to dispose of the writ petition by directing the respondent authorities to follow the guidelines issued by the Hon'ble Apex court in Re: Directions tn the mdtter of denolition of stntctures (supra) and, Rajendra Kumqr Bdrjdtga *nt Another os.
