The Court delivered the following: COMMON ORDER THE HONOURABLE SRI JUSTICE N.TUKARAMJI l.A.Nos.3 AND 4 OF 2025 "*,r,*ol COMMON ORDER r=r'rffiflo. rouu or roru This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha sanhita, 2029 (for short 'BNSS, 2023') seeking quashment of the proceedings against the petitioner-accused in C.C.No.1523 of 2023 on the file of the learned V Metropolitan Magistrate, M edcha I-Malkajgiri District.

2. The petitioner is anayed as sole accused in the Calendar Case registered for the offence punishable under Section 304-4 of lndian penat Code.

3. Heard Mr.Affan Azam Ali, learned counsel for the petitioner and Mr.Jithender Rao Veeramalla, learned Additional Public prosecutor, representing the respondent No.1-state and Mr.Mohd.Abdul Kalam siddiqui, learned counsel for the respondent Nos.2 and 3lde-facto complainant.

Pending this petition, the parties have entered into the compromise and, accordingly, respondent Nos.2 and 3lde-facto complainant filed l.A.Nos.3 and 4 of 2025 with the [jrayer to permit them to enter iy6 2 IA.Not.3 aad 4 o!2025 in/a CrlP.No. 7466 0J2025 compromise and by recording the settlement to quash the proceedings against the petitioner/accused in C.C.No.1523 of 2023.

5. This Court vide order' dated 03.07.2025 referred the parties to the High Court Legal Services Committee for identification and to verify the voluntariness in arriving the settlement. The Secretary, High Court Legal Services Committee, has submitted report dated 17.07.2025 stating that the parties were identified by their respective counsel and also on verification of Aadhar CardVldentity Cards and the enquiries revealed that the parties have willfully and without coercion .entered into seftlemenVcomPromise.

6. I have considered the submissions of the learned counsel and perused the materials on record.

7. Having considered the allegations, the nature of charged offences and taking into account the amicable settlement between the parties, in the light of the dictums in Gran Singh v. State of Puniab and anotherl and Anil Mishra v. Sfafe of ll.P.z; State of Madhya Pradesh v- Laxmi Narayan and others3, this Court is of the considered view that quashment of the impugned proceedings in view of the seftlement by | 2012 (1O) SCC 303 2 2024 INsc 189 3 zorg (s) scc oaa 3 Ivt_&/ IA.NosJ and4 of 2025 in/ and CrlP.No.7466 of 2025 exercising jurisdiction under Section 482 Cr.P.C.l528 of BNSS,2023, would be in the interest of justice.

Accordingly, l.A.Nos.3 and 4 of 2o2s are allowed. consequently, all the proceedings in C.c.No.1s23 of 2029, on the file of the learned v Metropolitan Magistrate, Medchal-Malkajgiri District., are hereby quashed against the petitioner/accused. 9 ln the above terms, the criminar petition is disposed of.
