SREENTVAS RAO CRIMIIYAL PETITIO II No. 638 r & 6393 of 20.25 COMMON ORDER: These Criminal petitions are filed under Sectio n 4g2 of Bharatiya Nagarik Suraksha Sanhitha, 2023 (for short BNSS) seeking anticipatory ba to the petitioners/accused Nos.r & 2 in F.I.R.No. 178 of 2O2S on the hle of police Station, Suraram, Cyberabad, Medchal-Malkajgiri District for the offences under Section f03(1), r/w 3(S) of Bharatiya Nyaya Sarrhita (for short "BNS"). 2' The case of the prosecution is that on 3r.o3.2o2s at 1130 hours a complaint has been given by the complainant Sri Govathoti Subba Rao in which he stated that, his niece son namely Sri Sujith was residing at Dp Colony, Jeedimetla. One Nanda Kishore and Sri Sujith both have studied in TVR School, SR Naik Nagar, IDA Jeedimetla one Manoj who is elder brother of Nanda Kishore often used to pick quarrel with Sri Sujith. On 30.03.2025 Sri Sujith while going to buy chicken at SR Naik Nagar, IDA Jeedimetla, Quthbullapur there Nanda Kishore and Manoj met with Sri Sujith and followed him. The sarne was Sri Sujith informed to Sri Hemanth who is son of the complainant. Immediately Sri Hemanth ald Sri Sujith went to them and questioned their activities, there petty quarrel sitfated them and went from there. Again on 31.03.2025 at I 2 about O73O hours, the said Nanda Kishore and Manoj both were called the Sri Hemanth and his friends Sri Mahesh, Sri Santhosh, Sri Abhishek through one Manikanth who is friend of Nanda Kishore ald Manoj and stated that, they are at Sri Mahesh house, they will discuss about the quarrel occurred yesterday. Accordingly Sri Hemanth and his three friends rushed to the place where Manikanta told to them. There while Manikanta talking with them meanlime aII of sudden Manoj beat the Sri Hemanth with stone on back side of neck. Later, there was scuffle between the both. Then Abhishek beat the Hemanth with hands. After that all were while leaving the place meantime father of Nandakishore came to the spot again raised the quarrel. While Sri Hemanth talking with Nanda Kishore and his father meantime Nanda Kishore beat the Sri Hemanth with centering stick in which Sri Hemanth received bleeding injury on his ear. Immediately he shifted him to Mallareddy Narayana Hospital and admitted there. Hence, the present crime has been registered. 3. Heard learned counsel for the petitioners/accused Nos. I and 2 and Mr.D. Arun Kumar, learned Additional Rrbric prosecutor for respondent -State.

Learned counsel for the petitioners submitted that the petitioners have not committed offence and they are falsely implicated in the present crime and ingredients under Section 3 103(1), r/w 3(5) of BNS does not attract against the petitioners and for the other offences that are alleged against the petitioners. It is further contended tiat the petitioners are ready and willing i to cooperate with the investigation and also ready to abide by the conditions, which are going to be imposed by this Court. Hence, the petitioners may be enlarged on anticipatory bail.

Per antra, the learned Additional Public Prosecutor submitted that petitioners have committed grave offence, investigation is under progress and if the petitioner granted anticipatory bail at this stage, she may tamper the evidence and may influence the witnesses, and hence, prayed to dismiss the petition.

Having considering the rival submissions made by the respective parties and after perusal of the material available on record, t-here are specific allegations against the petitioners to attract the ingredients of Section 103(1) r/w 3(5) of BNS. Even according to the learned Additional Public Prosecutor, the investigation is under progress and charge sheet has not been filed. Taking into consideration, the facts and circumstances of the case and gravit5r of the offence, this Court is not inclined to grant anticipatory bail to the petitioners/accused Nos.l and 2.
