BHASKAR REDDY II/RIT PETITION No.14590 of 2O25 ORDER This writ petition is filed seeking to declare the action of respondent Nos.2 to 5 in not taking any action on the representations of the petitioners dated 08.01.2025 in respect of the subject lands wherein and whereunder it is brought to the notice of the authorities about the alienation and the proposed layout sought to bc undertaken by unofficial respondent, as illegal, arbitrary and for other appropriate reliefs.

It is stated that the petitioners are the protected tenants of the lands admeasuring Ac.20.17 gts., in Sy.Nos' 15, 19, 21, 30,33,35,36 and 38, situated at Kongarakalan Village, lbrahimpatnam Mandal, Ranga Reddy District and entitled for issuance of the ownership certificate under the provisions of the Telangana Tenancy and Agricultural Lands Act, 195O (for short, 'the Act') and the Rules made thereunder. It is further stated that the pattadar-respondent No.6, without issuing any notice as required under Section 38D of the Act, has executed Agreement of Sale-cum-GPA bearing Document No.5460 of 2025, dated 76.04.2025 and also certain sale deeds in respect of the subject lands in favour of respondent No.7, therefore, the 2 CVBR, J \vp 459{) 2025 petitionrr:, lri1"'e made a detailed representation to res )ondent Nos.2 to I i r,:r 08.O 1.2025. Instead of taking appropriate recourse of approaching the Tribunal constituted undcr the provisions of the Act, this writ petition has been fi1ed seeking cancellation of the Agreement of Sale-cum-GPA alleged to have been executed by the pattadar in favour of the respondent No.7 and also certain sale deeds' In view of the above, this Court, while exercising powers 5. under Article 226 of tlle Constitution of India cannot delve into the rights of the petitioners vis-a-vis pattadars of the land and to examine the validity or otherwise of the Agreement of Sale- cum-GPA alleged to have becn executed by the pattadar in favour of the respondent No 7 or the sale deeds r'rnder the provisions of the AcL.
