Perused the record. 2 The present Civil Revision Petition is frled against the impugned order dated 26.11 .2024 passed in LA. No. 248 of 2021 in A.S. No. 50 of 2024 by the learned I Additional District and Sessions Judge, Jagtial (for short, 'the First Appellate Court').

3. The suit uiz., O.S. No. 81 of 2O1O is filed before the learned Senior Civil Judge, Jagtial (for short, 'the trial Court') for declaration of ownership and grant of perpetual injunction by the respondent Nos.l and 2/plaintiff Nos. 1 and 2 has been decreed on 29.O8.2O24. Aggrieved by the same, A.S. No. 5O of 2024 l:,as been prefcrred before tJle First Appellate Court. In the said appeal suit, the impugned I.A. No. 248 of 2024 \s t -.=5 --\ RY,.I cRP 1662 2025 2 Itled for staying the operation of the judgment and decree dated 29.08.2024 passed by the trial Court in O.S. No. 81 of

2010. The said impugned I.A. No. 248 of 2024 was dismissed as respondent Nos.1 and 2 / plaintiff Nos. I and 2 have no intention of frling any Execution Petition seeking any kind of relief as they are already in possession of the suit schedule property. Aggrieved by the said dismissal order, the present Civil Revision Petition is filed.

During the arguments, it is elicited that the only apprehension of the revision petitioners is that tl:.e uide judgment and decree dated 29.08.2024 certatn sale deeds have been declared as null and void and therefore, respondent Nos.l and 2 ni.ay take advantage of the same and alienate the suit schedule property the pendency of .during the appeal suit. In this regard, learned counsel for respondent Nos. 1 and 2 has represented that respondent Nos. 1 and 2 have no intention of alienating the suit schedule property as there is an intention to construct a nursing home in the suit schedule property.

Learned counsel for respondent Nos.1 and 2 is ready to give an undertaking to said effect that the suit schedule I ------7 RY,J cRP 1662 2025 3 property will not be alienated during the pendency of the appeal. When the apprehension of the revision petitioner is taken care, there is no other issue to be adjudicated in the Civil Revision Petition.

Accordingly, the Civil Revision Petition is disposed of in view of the undertaking given by the learned counsel for respondent Nos.l and 2 to the effect that respondent Nos.l and 2 have no intention to alienate the suit schedule property during the pendency ol the appeal suit.
