Counsel for the Petitioner: SRI NIMMALWAR PRAVEEN Counsel for the Respondents; AGP FOR REVENUE The Court made the following: ORDER I { I I I HON'BLE SRT .TUSTICE C.V.BHASKAR REDDY WRIT P ON No.144 O7o f 2o2s ORDER: This writ petition is filed seeking to declare the action of the respondents in not conducting survey for demarcation of Iand in Sy.No. 127136, to an extent of Ac.1.05 gts & Sy.No. 129/ 1 to an extent of Ac.2.O7 gts., total to an extent of Ac.3.06 gts., situated at Voni Viltage, Basar Mandal, Nirmal District, as iilegal, arbitrary and for other appropriate reliefs. 2. Considered the submissions of the learned counsel for the petitioners and learned Assistant Government pleader for Revenue appearing for the respondents and with their consent this writ petition is disposed of at the admission stage.

It is stated that the petitioner is the pattadar and possessor of land admeasuring Ac. l.O5 gts., in Sy.No_ 127l36a, Ac.2.01 gts., in Sy.No.129 /7., total admeasuring Ac.3.O6 gts., situated at Voni Village, Basar Maldal, Nirmal District. It is further stated that the name of the petitioner has been recorded irr revenue records and pattadar passbook has also been issued in respect of the subject property. It is the further stated that the petitioner, with an intention So fence the subject land, made F_Line application 2 :l CVBR, J Wp 14407 2O25 uide No.TTDtrRO224OL 1O139, dated 14.tO.2024 to respondent No.3, by paying requisite fee to conduct survey of tlre subject land and flx the boundaries. The grievance of the petitior.er is that even after receiving the said F-Line application, tt e respondent authorities are not conducting survey and fixing the roundaries.
4. Learned counsel for the petitioner has sub:nitted that in terms of the circular issued by the Commissi cner, Surwey, Settlements and Land Records, the respondents are bound to consider the application within 45 days from th,: date of the application after collec ting necessary charges.

Learned Assistant Government pleader for Revenue appearing for the re spondents has submitted that thr: respondents will consider the aforesaid F-Line application subr eitted by the petitioner by following due procedure raid down ur rder law and conduct survey and demarcate the subject lar d by fixing boundaries.

It is settled law that the Survey Departm:nt has the authority to conduct survey and demarcate lands in accordance with the provisions of the Telangana Land Revenue Ar t, 1317 Fasli (Act No. VIII of 1317 Fasli), the Telangana Survey anrI Boundaries Act, 1923, and the Rules framed thereunder. The Government has :,,,o, rxtr*.r.rrrtlt ;x *r" p;&# 3 CVBR, J Wp_14407 2025 issued various circulars specifying the conditions for conducting surveys, particularly F-Line (field measurement) surveys' Individuals requesting such surveys are required to submit specihc documents, and if the conditions stipulated in the circulars are fulhlled, the survey and boundary Iixation may be conducted' The Commissioner, Survey, Settlements and Land Records, exercising powers under the Telangana Survey and Boundaries Act, 1923, time uide issued relevant circulars from time to Rc.No.Nl/6543/99, dated 25.07.2OO1, Rc.No.N1/ 14O8/07, dated 13.07.2OO7, and Rc.No'N2/ 174 I l2OlO, dated 18 05'2010 stipulating the conditions for conducting survey of private lands and as per the said circulars, if the petitioner fulhlls all the conditions of the said circular, it is an obligation for the respondents to conduct survey within the time specihed in the said circulars. i f
