BHASKAR REDDY WRIT PETITION No.14591 of 2025 ORDER: This writ petition is filed seeking to declare the action of respondent Nos.2 to 4 in not considering the application No.2200O45198, dated 13.06.2022 made through online by the petitioner for correction/ restoration of missing survey number in Dharani portal ald issuance of patta passbooks in respect of land admeasuring Ac.0.2O gts., in Sy.No. 1Ig/AA/2 situated at Ananthawaram Village, Shabad Mandal, Ranga Reddy District, as illegal, arbitrary and for other appropriate reliefs.

It is stated that the petitioner is possessor of the land admeasuring Sy.No.1t9/AA/2 Mandal, Ranga Ac.0.20 gts., in situated at Ananthawaram Village, Shabad Reddy District, having purchased the same under registered sale deed bearing document No. lO53O of2O1B, dated 1 1.07.2018. Thereafter, it is stated that the petitioner made an application under the provisions of the Telangana I 0 2 CVBR, J wp 14591 2025 I Rights in Land and pattadar passbooks Act, lg7l (for short "the ROR Act, l97l"l for issuance of pattadar passbooks and the salne were not issued in view of repealing ROR Act, 1971 and replacing with Telangana Rights in Land and pattadar Passbooks Act, 1971 (for short "the ROR Act, 1971"). It is further stated that when the petitioner verified the dharani portal, the subject land is missing and therefore, she made an application, dated 13.06.2022 seeking correction / restoration of the missing survey number in Dharani portal and consequential issuance of e-pattadar passbook in respect of the subject property. The grievance of the petitioner is that even after receipt of the said application, the respondent authorities did not consider the same. Hence, the writ petition.

Sri L.Ravinder, learned Assistant Government pleader for Revenue has submitted that pending examination of the petitioner's application, the Act 9 of 2O2O has been repealed and replaced b1' the Telangana Bhu Bharati (Record of Rights in Land) Act, 2025 (for shorr .Act I ot 2025") and if the petitioner submits online application in the prescribed format in Bhu Bharati Web Portal and if the same fulfills all the requirements of the Act I of 2O2S and the Rules made thereunder, the i 3 CVBR, J Wp_ 14591 2025 respondent-authorities will consider the same in accordance I with law.

It is seen from the Rules framed under Bhu Bharathi Act, vide G.O.Ms.No.39 dated 14.O4.2025, any person aggrieved by an entry made in tlte record of Rights is entitled to make an application under Rule 4 of the Rules for the rectiflcation of the entries prepared and maintained under Section (1) and a(a) of the Act or any person who is in lawful possession of the land and claims right over the same but an entry was not made in record of Rights in respect of the said land, may apply through online in Bhu Bharati Portal for rectilication of entries or for making new entry in such record of Rights within a period of one year from the date of commencement of the Act by paying necessary fee prescribed for carrying out necessary corrections.

In view of the above, this Court deems it appropriate to dispose of this writ petition permitting the petitioner to make appropriate online application in the prescribed format in Bhu Bharati Web Portal, seeking correction/ restoration of the missing survey number in Dharani portal and consequential issuance of e-pattadar passbook in respect of the subject property. In the event of such application being made by the I t I 4 CVBR. J wp l{59 | 2025 \.l\ petrtloner and if the same fullills all the requirements under the provisions of the Act I of 2O2S and, the Rules made thereunder, the respondent-authorities shall examine and consider the case of the petitioner. In any event, if the application of the petitioner does not fulfill the requirements of the Act 7 of 2O2S and the Rules made thereunder, the respondent-authorities shall pass a reasoned order, in accordance with law and communicate the same to the petitioner. The entire exercise shall be completed within a period of three (03) months from the date of receipt of the application.

7. With the above observations, this Writ petition is disposed of. There shall be no order as to costs.
